Eligible graduating students whose concession validity expires between 28 & 31 Dec 2024, will enjoy a 4-month concession extension. More details can be found in the Concession & Monthly Travel Cards page.
These Conditions shall be binding on all persons ("Customers") to whom SimplyGo Pte. Ltd. (“SPL”) has issued an ez-link card (”ez-link Card") as well as any Customer who purchases or otherwise procures and uses an ez-link Card. These Conditions are published by SPL and govern the possession and use of the ez-link Card that may be used to effect transactions. These Conditions shall apply to any ez-link Card including any SimplyGo Concession Card.
These Conditions shall also govern the purchase and use of any Form Factor sold or distributed by SPL or any party authorised by SPL, and the subsequent use thereof by the Customer shall be deemed to be acceptance by the Customer of these Conditions and any revisions to these Conditions.
1. ISSUANCE OF EZ-LINK CARD
1.1 The ez-link Card is issued by SPL as both Major Payment Institution and Payment Service Provider licensed by the Monetary Authority of Singapore (“MAS”) under the Payment Services Act 2019.
1.2 SPL operates the ez-link Card in respect of the Customer’s use of the ez-link Card in accordance with these Conditions. The ez-link Card is distributed by SPL and/or SPL’s agents (“Agents”). The money advanced by the Customer for the ez-link Card or for topping up of the ez-link Card, as the case may be, is collected by SPL or the Agents for and on behalf of SPL.
1.3 For the purposes of these Conditions:-
“SimplyGo Concession Card” shall mean any ez-link card issued by SPL for the purposes of identifying persons entitled to concessionary travel by Transport Operators/ LTA and where the monies paid for and/or stored in a Wallet on the ez-link card are safeguarded by SPL under the Payment Services Act 2019, and includes:
· Child Concession Card (“Child Card”)
· Primary (MOE) Student Concession Card (“Primary (MOE) Card”);
· Primary (Non-MOE) Student Concession Card (“Primary (Non-MOE) Card”);
· Secondary/Pre-U (MOE) Student Concession Card (“Secondary/Pre-U (MOE) Card”);
· Secondary/Pre-U (Non-MOE) Student Concession Card (“Secondary/Pre-U (Non-MOE) Card”);
· Diploma Student Concession Card (“Diploma Student Card”);
· Undergraduate Concession Card (“Undergraduate Card”);
· Cards issued by Private Education Institutions (PEIs) registered with the Committee for Private Education (“PEI Student Card”);
· National Service Full-time Concession Card (“NSF Card”);
· PAssion National Service Full-time Concession Card (“PAssion NSF Card”);
· Senior Citizen Concession Card (“Senior Citizen Card”);
· PAssion Silver Concession Card (“PASC Card”);
· Adult Monthly Travel Card (“AMTC”);
· Workfare Transport Concession Card (“WTC Card”); and
· Persons with Disabilities Card (“PWD Card”)
“SimplyGo Concession Card Holder” shall mean the person to whom the concession privilege is granted and whose name and NRIC, FIN or Birth Certificate number is printed on the SimplyGo Concession Card or recorded electronically in the SimplyGo Concession Card.
“Authorised Person” shall mean such person authorised in writing by SPL to carry out such function as referred to in these Conditions.
“Card Holder” shall mean the person in possession of the ez-link Card or otherwise entitled to use the ez-link Card, including SimplyGo Concession Cardholders unless otherwise stated.
“ez-link Card” refers to any Form Factor which is linked to and can be used to access a Wallet, and which are sold or made available under SPL’s brand name “ez-link” that allows the Customer to make payment transactions at Qualified Merchants, and which includes any SimplyGo Concession Card.
“Fare Debt” shall mean any amount owing by a Card Holder arising from the shortfall of monies in the ez-link Card to cover the Fares incurred.
“Fares” shall mean the amount payable to the Transport Operators for the provision of Transit Services.
“Form Factor” shall mean any ez-link Card in any form, whether physical or virtual, which is sold or made available under SPL’s brand name “ez-link”, whether sold by SPL or its authorized parties, whereby Customer can access the Wallet in order to make payment of Qualified Goods and Services, as allowed by SPL. The Form Factor shall include but is not limited to e-wallet, cards, mobile SIM cards, novelty pieces, mobile communication devices and other electronic devices.
“monies” shall mean the monies paid for and/or stored in a Wallet (or the residual value remaining therein from time to time) linked to an ez-link card. This excludes the cost of any Form Factor.
“LTA” means the Land Transport Authority of Singapore, a statutory body formed under the Land Transport Authority of Singapore Act 1995.
“Minimum Travel Value” means the minimum Stored Value remaining in the ez-link Card that is required to commence a public transport trip.
“Passes” shall mean an electronic product offered by SimplyGo or Qualified Merchants designated by the relevant authorities in Singapore that can be encoded onto specific concession cards to confer concessionary travel at a fixed pricing on specific Public Transport System modes.
“PTC Act” shall mean the Public Transport Council Act 1987 as amended from time to time.
“Public Transport System” shall mean the public bus and rail systems from time to time operated by the Transport Operators.
“Qualified Goods and/or Services” shall mean the goods sold and/or the services rendered by Qualified Merchants.
“Qualified Merchants” shall mean persons approved by SPL and/or Authorised Persons to be engaged in the sale of the Qualified Goods and/or the provision of Qualified Services. Qualified Merchant shall be authorized by SPL to accept the ez-link Card as a means of payment for such Qualified Goods and/or Services and may include but not be limited to public transport operators licensed by the relevant authorities in Singapore (“Transport Operators”).
“Stored Value” shall mean the initial monetary value paid for and stored in an ez-link Card, including by means of a top-up, or the residual value remaining therein from time to time (excluding the Card Cost (as defined hereinafter)), which may be used by an ez-link Card Holder for the payment of Transit Services and/or Qualified Goods and/or Services.
“Ticket” shall mean an ez-link card which is issued as a form of authorisation for the conveyance of any passenger on the Public Transport System, as understood within the context and meaning of the PTC Act.
“SimplyGo” or “SPL” shall mean SimplyGo Pte Ltd, its successors and assigns.
“Transit Services” shall mean the services from time to time provided by the Transport Operators for or in connection with the transportation of passengers on the Public Transport System.
“Transit Ticketing Machines” shall mean any devices located at MRT/LRT stations and bus interchanges that are used to provide ticketing services.
“Wallet” refers to a stored value account issued by SPL which can be accessed using an ez-link Card.
2. CONDITIONS OF USE
2.1 All ez-link Cards are issued subject to these Conditions which shall be binding on all Customers.
2.2 The Customer agrees :- (i) to comply with all the notices, guidelines, rules and instructions pertaining to the use of the ez-link Card as issued by SPL from time to time, including operating rules and/or policies that may be published from time to time by SPL; (ii) to abide by all applicable laws and regulations in the use of the ez-link Card; (iii) not to tamper or allow anyone to tamper with the ez-link Card; (iv) to use the ez-link Card only as a means of payment for Qualified Goods and/or Services; (v) not to intentionally deface, damage and/or destroy the ez-link Card; (vi) to take proper care of any ez-link Card and not to alter, remove and/or replace any notices, trademarks, trade names, logos, artwork or designs on the ez-link Card.
2.3 The Customer acknowledges that SPL is the Major Payment Institution and Payment Service Provider (as defined under the Payment Services Act 2019) of the ez-link Card and the corresponding Wallet linked to it, and shall hold and be fully liable for all monies deposited by the Customer, and be responsible to the Customer for refunds of any monies when the Customer makes a request for refund. SPL shall meet the Customer’s redemption by making payment to Qualified Merchants who have provided Qualified Goods and/or Services to the Customer. SPL shall be responsible to the Customer for all administrative matters relating to the ez-link Card as contemplated under these Conditions, and SPL may appoint Agents to carry out such functions on its behalf.
2.4 The use of an ez-link Card as a means for the payment of fares in the Public Transport System shall be subject always to these Conditions and the “Transit Usage Conditions” published on the SimplyGo website at www.simplygo.com.sg, which shall prevail over these Conditions in the event of any conflict or inconsistency.
2.5 The Customer may have access to card-related services, including but not limited to transaction history, lost card blocking and top-ups by downloading the SimplyGo mobile app, which terms of usage is available for viewing at www.simplygo.com.sg.
3. VALIDITY OF THE EZ-LINK CARD
3.1 Subject to paragraph 3.7, an ez-link Card is valid for use for 5 years from the date that it is encoded for use by SPL (the “Validity Period”), and thereafter the ez-link Card shall expire (“Expiry Date”). The validity of the ez-link Card may also be shorter or longer than 5 years as may be notified by SPL to the Customer at the point of sale/issuance of any ez-link Card in any product packaging or otherwise at the point of issuance of the ez-link Card. SPL may at its discretion and from time to time extend the Validity Period for any or all types of ez-link Cards.
3.2 SPL or its appointed agent may at its discretion blacklist any ez-link Card where :
(a) the ez-link Card is suspected of being counterfeited, stolen, lost, tampered with or fraudulently issued or procured; or
(b) the monies have been fraudulently or illegally topped-up or otherwise accessed; or
(c) the ez-link Card is or are otherwise suspected of being faulty, damaged or invalid for use.
3.3 In the event that the Stored Value in the ez-link Card is less than the Minimum Travel Value applicable to the ez-link Card, the ez-link Card will be blocked from usage. The Customer shall be required to top-up the blocked ez-link Card, and he/she acknowledges and understands that there may be some system delay before the blocked ez-link Card is enabled for payment.
3.4 Where any ez-link Card has been blacklisted, the Customer shall not be entitled to use the ez-link Card, and the monies shall not be refunded to the Customer except with the approval of SPL.
ISSUE AND VALIDITY OF SIMPLYGO CONCESSION CARDS
3.5 SimplyGo Concession Cards shall be issued only to eligible applicants. Details on concession schemes, concession travel rates, Passes, eligibility for concession travel and conditions relating to concession schemes offered by the Transport Operators / LTA are stipulated at www.simplygo.com.sg.
3.6 A SimplyGo Concession Card is not transferable and can only be used by the SimplyGo Concession Card Holder of that Concession Card.
3.7 The extension of the validity period is at the absolute discretion of the Transport Operators or LTA. In the case of any Child Card, Primary (MOE) / (Non-MOE) Card, Secondary / Pre-U (MOE) / (Non-MOE) Card, Diploma Student Card and/or Undergraduate Card, the extension shall be subject to the provision of all relevant information by the school or institution concerned. Save as aforesaid, SimplyGo Concession Card Holders may seek the extension of their concession status at any devices that have been approved by LTA for such purpose.
3.8 The use of a SimplyGo Concession Card as a means for the payment of fares in the Public Transport System shall be subject always to these Conditions and such of the terms and conditions as may from time to time be issued by LTA or such other organisation as may be designated by LTA from time to time to govern the use of any contactless payment medium in the Public Transport System, which terms and conditions shall prevail over these Conditions in the event of any conflict or inconsistency.
3.9 A replacement SimplyGo Concession Card may be issued subject to such conditions and to the payment of such sums as published on www.simplygo.com.sg.
4. TOP-UP OF EZ-LINK CARD
4.1 An ez-link card holder may top-up their Card from time to time at any Transit Ticketing Machine and any other physical or electronic channel accepted by SPL via cash, NETS (or such other accepted payment modes), up to the maximum amount of $500.00 or other amount as may be prescribed for such ez-link Card. This excludes the cost of any Form Factor.
4.2 An ez-link card holder may apply for the Auto Top-up by Credit Card service or the Auto Top-up by GIRO service, which terms are available for viewing at www.simplygo.com.sg.
5. TRANSACTIONS USING THE EZ-LINK CARD
5.1 The ez-link Card shall and can be used as a means of payment for Qualified Goods and/or Services, subject always to these Conditions.
5.2 SPL, LTA, any Authorised Person, Transport Operators and/or the Qualified Merchants may reject the use of the ez-link Card for payment of Qualified Goods and/or Services if:-
(a) It is suspected to be a counterfeit; or
(b) there are insufficient funds; or
(c) the ez-link Card has been blacklisted; or
(d) the Validity Period of the ez-link Card has expired; or
(e) the ez-link Card is suspected to have been fraudulently issued, Top-up, stolen or tampered with or may in any way pose a risk to the system or prevents the proper deduction of Fares or to evade any Fare payment; or
(f) the ez-link Card system is unable to process the payment for any reason whatsoever or if a force majeure event or system failure arises which disables and/or prevents the Qualified Merchants from accepting and/or processing the ez-link Card as a means of payment; or
(g) the ez-link Card is damaged, unreadable, defective, faulty or otherwise poses a risk of damage to the system;
(h) the ez-link Card is not capable or has ceased to be capable of functioning as a Ticket for any reason whatsoever;
(i) the ez-link Card has not been activated for use in the Public Transport System.
(j) a SimplyGo Concession Card is used by any person who is not eligible or who has ceased to be eligible for concessionary travel; or
(k) a SimplyGo Concession Card is used by any person who is not the SimplyGo Concession Card Holder to whom the SimplyGo Concession Card is issued.
5.3 The Customer agrees that each of the Qualified Merchants is responsible for deducting payment for Qualified Goods and/or Services that the Customer has agreed with the Qualified Merchant or is agreeable (with the Qualified Merchant) to pay from the ez-link Card, in such manner as may be required by such Qualified Merchant.
5.4 The Qualified Merchants accepting the use of ez-link Card may be changed from time to time without prior notice.
5.5 Where an ez-link Card which was previously blacklisted (pursuant to paragraph 3.2), is subsequently removed by SPL from the blacklist after the reason for the blacklist has been resolved to SPL’s satisfaction, such ez-link Card may still be temporarily unavailable for use pending the ez-link Card system update, and the Customer agrees and understands that SPL shall not be liable for the non-availability of the ez-link Card during such period.
6. QUALIFIED GOODS AND/OR SERVICES OF QUALIFIED MERCHANTS
It is expressly acknowledged by the Customer that neither SPL nor any Agent is involved in the provision of the Qualified Goods and/or Services offered by any Qualified Merchant accepting the ez-link Card for payment. Neither SPL nor any Agent shall be liable in any way for the Qualified Goods and/or Services sold, rendered or provided by the Qualified Merchants (including without limitation any defect, disruption, failure or unavailability of or relating to any of such Qualified Goods and/or Services, as the case may be) or for any other disputes concerning the Qualified Goods and/or Services, all of which shall be the sole responsibility of the Qualified Merchants.
7. RETENTION OF SIMPLYGO CONCESSION CARDS
7.1 Notwithstanding any other clause, SPL, LTA, any Authorised Person and/or any of the Transport Operators shall be entitled to seize and retain the SimplyGo Concession Card if:
(a) it is used by a Concession Card Holder who is not eligible or who has ceased to be eligible for concessionary travel;
(b) it is used by a person who is not the Concession Card Holder of that SimplyGo Concession Card;
(c) it has expired;
(d) it is suspected by SPL, LTA, any Authorised Person and/or the Transport Operators:
(i) to be a counterfeit;
(ii) to have been fraudulently or illegally issued or topped-up;
(iii) to have been stolen or tampered with in any way; or
(iv) to have been used in a manner which illegally or fraudulently hinders or prevents the proper deduction of Fares or to evade any Fare payment;
(e) it is damaged, unreadable, defective, faulty or otherwise poses a risk of damage to the Concession Card System;
(f) it has been blacklisted for any reason whatsoever;
(g) it is not capable or has ceased to be capable of functioning as a Ticket for any reason whatsoever.
8. REFUNDS ON THE EZ-LINK CARD
8.1 Subject to paragraphs 3 and 8, a refund of the monies remaining (whether valid or expired) can only be obtained by a Customer if the ez-link Card is presented at any Ticket Office or Ticketing Service Centre at MRT stations and bus interchanges or at such other places or via such other channels as may be designated or authorized by SPL. Refunds may also be effected through such online means as may be determined by SPL. Customers may refer to the SPL website at www.simplygo.com.sg for the refund channels available. The amount of monies remaining (whether valid or expired) shall be as determined by SPL and/or the Agents and will be refunded free of interest. The ez-link Card shall be returned to the Customer after refund, except for SimplyGo Concession Card which shall be retained by SPL. Notwithstanding the foregoing, SPL or its Agent may require the ez-link Card to be retained for investigations to determine the value of the remaining monies. Where a refund request requires SPL to conduct investigations, the remaining monies will be refunded upon completion of the investigations. The remaining monies will be determined based on SPL’s system records. However, no refund of the monies will be made on any expired ez-link Card after 7 years from the Expiry Date whereupon the Customer shall have no claim against SPL in respect of the monies remaining, whereupon SPL shall be fully entitled to deal with any unclaimed monies as it thinks fit.
8.2 Other than as provided in paragraph 8.1 above, neither SPL nor any of the Agents shall be obligated to make a refund to any Customer or to process any Customer’s request for refund on any ez-link Card (whether valid or expired). Notwithstanding the foregoing provision, each of SPL and the Agents may at their absolute discretion make a refund or process a refund in respect of the monies or any part thereof, and any such refund may be made and/or processed subject to conditions imposed by SPL and/or the Agents on SPL’s behalf. SPL and/or the Agents shall not be obliged to effect an immediate refund, and may, in its absolute discretion, refund the monies on any ez-link Card in such manner and upon due verification as it deems fit.
8.3 In any case, each of SPL and the Agents will not be liable to make a refund of the monies if :-
(a) the ez-link Card is not surrendered by the Customer at the time of a request for refund or the Customer is otherwise not able to establish proof of ownership; or
(b) the ez-link Card’s electronic data and/or its external card number are not available or reliably readable for any reason whatsoever as determined by SPL and/or the Agents; or
(c) the ez-link Card is altered, tampered with, intentionally damaged, or interfered with; or
(d) the ez-link Card is counterfeited, stolen, lost, tampered with with or fraudulently issued or procured;
(e) the monies are suspected by SPL to have been fraudulently or illegally topped-up; or
(f) the ez-link Card has a Fare Debt or any other amount owing, until such time the Fare Debt or amount owing has been settled.
8.4 Subject to paragraph 8.5, a Customer shall be entitled to a refund of the monies at any time up to 7 years from the Expiry Date, PROVIDED that where the request for refund was made more than 2 years after the Expiry Date, SPL shall be entitled to levy a monthly service charge (“Refund Service Charge”) of S$1.00, for each ez-link Card that is surrendered for refund more than 2 years after the Expiry Date. The Refund Service Charge shall be deducted monthly from the remaining monies commencing 2 years from the Expiry Date until request for refund is made or when the remaining monies are fully depleted, whichever is the earlier. The Refund Service Charge will not apply to SimplyGo Concession Cards. For the avoidance of doubt, the Customer shall not be entitled to a refund after 7 years from the Expiry Date.
8.5 A Customer who makes a request for refund at the designated places referred to in paragraph 8.1 above shall, upon request, produce such identity document for inspection to verify the identity of the Customer. Each of SPL and the Agents may at their absolute discretion refuse any request for the refund of the monies, if the Customer does not produce his/her identification.
8.6 The Customer shall, upon receipt of the refund, be deemed to have accepted the amount thereof as correct, and agrees to discharge each of SPL and the Agents from any liability whatsoever to the Customer, including but not limited to any shortfall or error in the amount of such refund.
8.7 Where the Customer has made a request for refund, and SPL and/or the Agents is required to effect a deferred refund of the remaining monies, SPL and/or the Agent may stipulate a refund collection period of not less than 90 calendar days for the Customer to collect his refund. In the event that the Customer fails or neglects to collect his refund or is otherwise unable to produce proof of the request for refund within the stipulated refund collection period, the Customer shall be deemed to have abandoned his claim to the refund and shall have no further right to claim against SPL for the refund. SPL shall thereafter have the right to deal with the refund as it deems fit.
9. DETERMINATION OF VALUE IN WALLET
The determination by SPL and/or the Agents as to the remaining monies on a Wallet shall be final and conclusive. For the purpose of such determination, the remaining monies as determined by SPL and/or the Agents from the records of SPL or the information generated by the ez-link Card system shall, save for manifest error, be deemed to be conclusive and binding against the Customer.
TERMS RELATING TO SALE AND USE OF EZ-LINK CARD
10. EZ-LINK CARD COST
SPL or its agents or resellers may collect an amount to cover the cost of the ez-link card (“ez-link Card Cost”). The ez-link Card Cost, in the case of a physical card is up to a maximum of S$5.00. Notwithstanding the foregoing, SPL or its agent may collect from the Customer such amount higher than S$5.00 for the purchase of certain types of ez-link cards or other Form Factors. The ez-link Card Cost is non-refundable.
11. REPLACEMENT OF DEFECTIVE EZ-LINK CARD
11.1 Subject to paragraphs 11.2, 11.3, 11.4 below, a Customer may replace a defective ez-link Card by presenting it at any Ticket Office or Ticketing Service Centre at MRT stations and bus interchanges (excluding SimplyGo Concession Card, which may be replaced only at Ticketing Service Centre). The monies in the Wallet on the defective ez-link Card shall be refunded to the Customer in accordance with paragraph 8. SPL may specify a minimum amount to be deposited for the Customer to be entitled to receive the replacement Form Factor. The defective ez-link Card shall be surrendered to and retained by SPL and/or the Agent upon such request for replacement.
11.2 Other than as provided in paragraph 11.1 above, neither SPL nor any of the Agents shall be obligated to replace any ez-link Card (whether defective or not). Notwithstanding the foregoing provision, each of SPL and the Agents may at their absolute discretion replace the ez-link Card, and any such replacement may be made subject to conditions imposed by SPL and/or the Agents on SPL’s behalf.
11.3 In any case, each of SPL and the Agents will not be liable to replace the ez-link Card for free as provided in paragraph 11.1 if:-
(a) the ez-link Card is not surrendered by the Customer at the time of request for replacement; or
(b) SPL and/or the Agents in its discretion determine that the ez-link Card has been damaged whether intentionally or by failure to take proper care of the ez-link Card or otherwise used or handled in breach of paragraph 2.2 herein; or
(c) the ez-link Card has been de-laminated, peeled, tampered with, broken or otherwise damaged due to wear and tear; or
(d) SPL and/or the Agents are unable to reliably read or ascertain the identification account number associated with the ez-link Card for any reason whatsoever; or
(e) the ez-link card has a Fare Debt or any other amount owing, until such time the Fare Debt or any amount owing has been settled;
(f) the Validity Period of the ez-link Card has expired.
11.4 The determination by SPL and/or the Agents as to the amount of monies on a defective ez-link Card shall be final and conclusive (see paragraph 9 above). SPL reserves the right to subsequent adjustments to such determination should any transaction records received late indicate a different value than that determined at the time of replacement.
12. CORRUPTED SIMPLYGO CONCESSION CARD
12.1 Concession Card Holders with corrupted, defective or faulty SimplyGo Concession Cards shall present such Concession Cards for replacement at any Ticketing Service Centre immediately after such corruption, defect or fault has arisen.
13. REPLACEMENT OF DEFECTIVE NON-CARD FORM FACTOR
SPL does not, unless otherwise expressly stipulated in the terms of sale, provide any product warranty for any Non-Card Form Factor. Where a Non-Card Form Factor purchased from SPL is defective (not through any fault or act of the Cardholder) prior or during the first use for payment or use of the Non-Card Form Factor, SPL or its agents or resellers shall replace the defective Non-Card Form Factor with a similar or like product. Subject to any prevailing law, SPL or its agents or resellers shall not be liable to replace any Non-Card Form Factor that is found to be defective at any second or subsequent use.
14. LOSS OF EZ-LINK CARD
14.1 Customers are responsible for safeguarding their ez-link Card against loss, damage or theft, and ensuring that their ez-link Card are not used by any person without the Customer’s permission. Each of SPL, the Agents and the Qualified Merchants accepting the Form Factor for payment for Qualified Goods and/or Services are not responsible for any financial losses incurred due to the loss or unauthorized use of an ez-link Card and have no obligation whatsoever to prevent the use of a lost ez-link Card by a person other than the Customer.
14.2 Where SPL and/or the Agents are in possession of any lost ez-link Card, the Customer may reclaim the ez-link Card provided that the Customer is able to produce proof of ownership to the satisfaction of SPL and/or the Agents. Except for SimplyGo Concession Cards, Customer shall not have any claim to any lost ez-link Card or the monies therein if the lost ez-link Card remains unclaimed after two weeks in SPL and/or the Agents’ possession. SPL shall be fully entitled to deal with the remaining monies on such lost Form Factor as it thinks fit.
14.3 Card Holders of SimplyGo Concession Cards who lose their card must immediately report the loss of their card to SPL through the SimplyGo Hotline, SimplyGo mobile app or any other channels as may be permitted by SPL for the purposes of invalidation. Once invalidation requests are reported by the Card Holder, these are final and irreversible. The lost ez-link Card may take up to 48 hours to be invalidated from the time of the request, save for SimplyGo Cards which will be invalidated immediately upon the time that SPL has received the loss report.
15. SAFEGUARDING OF FUNDS
15.1 SPL will safeguard all monies received from Card Holders under this Terms and Conditions as relevant money (“relevant monies”) as defined in Section 23 of the Payment Services Act 2019. Customers understand and acknowledge that:
(a) ll relevant monies will be held by SPL on the Card Holders’ behalf in a separate trust account held with a Safeguarding Institution (as defined in Section 23 of the Payment Services Act 2019) in Singapore;
(b) relevant monies received by SPL will be deposited in the trust account together with, and commingled with, relevant monies received by SPL from other Card Holders;
(c) the risk of such commingling is that in the unlikely event of SPL system failure, the amount held by SPL on behalf of the Card Holder may not be distinguished from monies of other Card Holders in the same account;
(d) in the unlikely event of insolvency of the Safeguarding Institution, there is a risk where the Card Holder may not be able to fully recover the Card Holder’s relevant monies; and
(e) no interest will be payable to Card Holder in respect of relevant monies maintained kept by SPL on Card Holder’s behalf in the trust account.
16. EXCLUSION OF LIABILITY
16.1 Notwithstanding anything to the contrary contained herein, each of SPL and the Agents shall not be liable, whether or not arising out of the negligence of each of SPL, the Agents and/or their respective officers, employees, or agents, for any losses, damages, expenses, claims, liability and costs (including cost on a solicitor and client basis) that the Customer may incur or suffer in connection with:-
(a) the use or issue of ez-link Card; or
(b) any delay in issuing of ez-link Card or suspension or discontinuance of issuing of ez-link Card;
(c) any period where any equipment, software or system is unavailable for processing the use of the ez-link Card for payment; or
(d) any delay or detention arising from use of the ez-link Card.
16.2 Damaged or defective ez-link Card may not be accepted in the equipment used by the Qualified Merchants. Neither SPL nor the Agents shall be liable for any loss, delay or inconvenience that may be incurred if the ez-link Card is not accepted in such equipment.
16.3 Notwithstanding any other provision of these Conditions, SPL’s total liability to the Customer under these Conditions and at law shall not exceed in aggregate the sum of S$500.00 per ez-link Card.
16.4 SPL’s total liability to a Customer shall not exceed the aggregate of the remaining monies of such Customer’s ez-link Card as of the date the Customer’s claim arises.
17. AMENDMENT
SPL may from time to time amend any part of these Conditions. SPL will give notice of any amendment by posting the same at its website at www.simplygo.com.sg, the premises of the Agents and/or such other premises as may be determined by SPL. The Customer agrees that any notification of amendments as aforementioned shall be sufficient notice for the purpose of this paragraph. If the Customer does not accept any amendments, he shall cease all use of the ez-link Card. The Customer’s continued use of the ez-link Card after the date of such notification shall constitute an affirmative acknowledgement by the Customer of the amendments and shall be deemed to be the Customer’s acceptance of such revised Conditions.
18. NO WAIVER
No failure or delay on the part of SPL in exercising any power, right, or remedy under these conditions shall operate as a waiver of such power, right, or remedy.
19. RIGHT OF THIRD PARTIES
A person or entity who is not a party to these Conditions shall have no right under the Contracts (Rights of Third Parties) Act, chapter 53B of Singapore to enforce any term of these Conditions, regardless of whether such person or entity has been identified by name, as a member of a class or as answering a particular description. For the avoidance of doubt, nothing in this paragraph shall affect the rights of any permitted assignee or transferee of these Conditions.
20. FORCE MAJUERE
Neither SPL nor any Agents shall be liable for non-performance, error, interruption or delay in the performance of their obligations under these Conditions, if this is due, in whole or in part, directly or indirectly to an event or failure which is beyond its reasonable control which includes without limitation:- (i) flood, lightning, acts of God, fire, earthquakes and other natural disasters; (ii) judgements, legislation, acts, orders, directives, policies, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any court, governmental, parliamentary and/or regulatory authority imposed or to be imposed after the fact; (iii) power failure; (iv) acts or defaults of any telecommunications network operator; (v) circumstances where communications lines and/or computer systems of SPL, the Agents and/or the Qualified Merchants cannot be used for reasons attributable to third party telecommunications carriers; and (vi) acts or omissions of any Qualified Merchant or any party for whom SPL and/or the Agents are/is not responsible.
21. INDEMNITY
The Customer hereby undertakes and agrees to indemnify SPL and keep SPL at all times fully indemnified from and against all actions, proceedings, claims, liabilities (including statutory liability), penalties, demands and costs (including without limitation, legal costs of SPL on a solicitor and own client basis), awards, damages, losses and/or expenses however arising directly or indirectly by reason of and/or as a result of any breach or non-compliance by the Customer of the terms and conditions herein.
22. GOVERNING LAW
The construction, validity and performance of these Conditions shall be governed by and construed in accordance with Singapore law. Each party mentioned herein hereby submits to the non-exclusive jurisdiction of the Singapore courts.
22. TRANSIT USAGE CONDITIONS AND ENFORCEMENT
22.1 The use of the ez-link Card shall be subject to the Transit Usage Conditions, which is available for viewing at www.simplygo.com.sg.
22.2 SPL, the Transport Operators and/or the Agents shall be entitled without assigning any reason therefore to retain any ez-link Card which it reasonably suspects or has reason to believe to have been blacklisted, fraudulently issued, stolen, tampered with and/or used any personalized ez-link Card (which was not issued to the person using such ez-link Card or which the person is not entitled to the use thereof, or where the ez-link Card has been blacklisted.

The use of a Card for payment of Fares for travel in the Public Transport System shall be subject to the Card Issuer's terms and conditions as may from time to time be applicable to the use of the Card ("Issuer's Terms"), these Conditions, and all applicable laws and regulations Provided Always that these Conditions shall prevail over the Issuer's Terms in the event of any conflict or inconsistency. By using a Card for payment of Fares for travel in the Public Transport System, the Card Holder agrees to be and shall be bound by these Conditions.
1. Definitions
In these Conditions, the following words and expressions shall, unless otherwise provided or the context otherwise requires, have the following meaning:
“Act” refers to the Public Transport Council Act 1987 as amended from time to time.
“Authorised Personnel” refers to SimplyGo, Operators and/or any person authorised by the relevant authorities in Singapore.
“Bank Card” refers to any contactless NETS bank card, Mastercard or Visa credit, debit or prepaid card including Mobile Payment, or any other payment scheme cards approved by the Land Transport Authority (LTA).
“Bus(es)” refers to bus(es) operated by Operators.
“Card” refers to any CEPAS Stored Value card, Bank Card, and includes by definition any form factor accepted by LTA, for use as a means of payment for transit services in the Public Transport System.
“Card Holder” refers to a person who holds and uses a Card issued by the Card Issuer and which is accepted for use as a means of payment for transit services in the Public Transport System.
“Card Issuer” refers to the financial institution or corporation issuing the Card.
“CEPAS” refers to the Singapore Specification for Contactless e-Purse Application.
“Fares” refers to the amount payable to the Operators for the use of Public Transport System.
“Fare System” refers to the computerised system authorised by LTA for the payment of Fares in the Public Transport System.
“LTA” refers to the Land Transport Authority of Singapore, a body corporate established under the Land Transport Authority of Singapore Act 1995.
“Mobile Payment” refers to the point-of-sale payment made by a mobile device including smart phone and smart watch with Near Field Communication (NFC) capabilities.
“Operators” refers to the public bus and rail system operators licensed by the relevant authorities in Singapore and such other persons as may be specified by LTA from time to time.
“PTC” refers to the Public Transport Council of Singapore, as established under the Act.
“Public Transport Official” refers to any employee or class of employees of PTC, Operators or LTA appointed by PTC under the Act.
“Public Transport System” refers to the public bus and rail systems from time to time operated by the Operators.
“Rail” refers to the Mass Rapid Transit and Light Rapid Transit Systems under the Rapid Transit Systems Act 1995.
“SimplyGo” refers to SimplyGo Pte. Ltd.
“Stored Value” refers to the monetary value paid in advance for and stored in a Card, including by means of a revaluation, or the residual value remaining therein from time to time, which may be used by a Card Holder for the payment of Transit Services.
“Transit Usage Device” refers to any public transport fare payment device forming part of the Fare System which is used to effect the payment of Fares.
2. Payment of Fares
2.1 A Card Holder shall exercise due care and diligence when presenting his/her Card onto any Transit Usage Device so as to enable the proper deduction of Fares. Without prejudice to the generality of the foregoing, a Card Holder
shall:
(a) Ensure that the Card is properly tapped at the Transit Usage Device at the point of boarding and alighting a Bus or when entering and exiting a Rail station fare gate for correct Fare deduction. Failure to tap the card upon boarding/entering may result in the Card Holder being penalised
for fare evasion during inspection by Public Transport Officials; and
(b) Ensure that only the same Card is presented at the Transit Usage
Device for boarding and alighting a Bus or when entering and exiting a Rail station fare gate for correct Fare Deduction.
(c) Ensure that the Card has sufficient value, credit limit, funds and validity before presenting it for Fare payment.
2.2 Subject to the Act, each Operator is at liberty to determine the manner in which Fares are payable. The Card Holder agrees to the deduction from the
Stored Value, credit limit or funds of his/her Card of such Fares as are due to the Operators when using the Public Transport System.
2.3 A Card Holder shall show his/her Card to any Authorised Personnel upon
demand whenever the same is presented for the purposes of Fare payment.
2.4 No additional charges will be imposed when using Singapore-issued Bank Card. An administrative fee of $0.60 will be imposed on foreign Bank Card per day of use for fare payment.
2.5 After using a Bank Card for fare payment, the Card Holder may see a pre- authorisation charge reflected on their Bank Card statement as an earmark which will be released based on the respective issuing bank policies.
3. Rejection of Card
3.1 SimplyGo and/or the Operators shall be entitled to reject the use of a Card as a means of Fare payment in the Public Transport System if:
(a) The Card has expired;
(b) The Stored Value of the Card is insufficient;
(c) The Bank Card has insufficient credit limit and/or insufficient funds;
(d) The Card is suspected by SimplyGo and/or the Operators:
to be a counterfeit;
to have been fraudulently or illegally issued or revalued;
to have been lost, stolen or tampered with in any way; or
to have been used by a person to whom it was not issued or who is otherwise not entitled to the use thereof;
(e) The Card is damaged, corrupted, defective, faulty or otherwise poses a
risk of damage to the Fare System (including any Transit Usage Device);
(f) The Card has been blacklisted by the Card Issuer or has been made the subject of any recall or retention by the Card Issuer;
(g) The Card has not been activated for use in the Public Transport System; or
(h) The Card is not capable or has ceased to be capable of functioning as a means for the payment of Fares in the Public Transport System for any other reason whatsoever.
3.2 In the event that a Card is rejected at the point of boarding a Bus or entering the Rail station fare gate, the Card Holder shall pay the Fare in cash (for Bus only) or with the use of a valid Card, or otherwise shall be disallowed to
board the Bus or enter the fare gate.
3.3 In the event that the Card is rejected on the card reader at the point of alighting from a Bus, Card Holder will be charged the full fare from the boarding point to the terminal stop of the bus service.
3.4 In the event that a Card is rejected at the point of exit from a Rail station fare gate, Card Holder could approach the Passenger Service Centre or Intercom for assistance and/or use an alternate form of payment for the trip in order to exit the fare gate.
3.5 The Card Holder shall be entitled to a refund of any excess Fares collected provided always that the rejection of the Card is not through the Card
Holder's fault and the Card Holder can present relevant proofs for such rebate within the period set forth in Clause 5.
4. Retention of Card
4.1 Authorised Personnel reserve the right to seize any Card subject to Card
Issuer’s agreement, which is rejected pursuant to Clause 3.1 (a), (d), (e) and (f). SimplyGo and/or Operators shall not seize any Bank Card which is
rejected pursuant to Clause 3.1 unless authorised by the Card Issuer.
4.2 Subject to Clause 4.1, a Card Holder shall surrender his/her Card to
Authorised Personnel upon demand and shall, in connection thereto, provide his/her name, NRIC or other identification number, address and contact
number, in return for which the Card Holder shall be issued with a receipt or an acknowledgement form for the retained Card ("Retention Receipt"), and shall, where duly requested to do so, provide his/her fullest cooperation in
connection with the investigation which may be carried out in relation to such retained Card.
4.3 In the event that a Card is retained, the Card Holder shall pay any unpaid
Fare in cash or with the use of a valid Card. The Card Holder shall be entitled to refund of any excess Fares provided that the retention of the Card is not
through the Card Holder's fault and the Card Holder can present relevant proofs for such rebate claims within fourteen (14) calendar days of the
incident (for EZ-Link, NETS FlashPay and SimplyGo EZ-Link/Concession Card) and sixty (60) calendar days of the incident (for Bank Card).
4.4 Card Holders can call the SimplyGo Hotline after five working days to check
on the status of a retained Card by quoting the Retention Receipt number. No query or claim made in respect of any retained Card shall be entertained in
the event that the Card Holder is unable to produce a Retention Receipt or a Retention Receipt number.
4.5 Authorised Personnel shall not be obliged to return a retained Card and may retain it permanently if, further to their investigations, the Card is determined which shall be final and binding:
(a) to be expired;
(b) to be a counterfeit;
(c) to have been fraudulently or illegally issued or revalued;
(d) to have been lost, stolen or tampered with in any way;
(e) to have been used by a person to whom it was not issued or who is otherwise not entitled to the use thereof;
(i) The Card is damaged, corrupted, defective, faulty or otherwise poses a
risk of damage to the Fare System (including any Transit Usage Device); or
(f) to have been blacklisted by the Card Issuer or to have been made the subject of any recall or retention by the Card Issuer.
4.6 Any and all claims by a Card Holder in respect of a retained Card (including, without limitation, the refund of any Stored Value, the return of any retained Card and/or for compensation) must be made within a period of three months commencing from the date on which the Card was retained, failing which the Card Holder shall be deemed to have waived his right to claim and shall not be entitled to any payment whatsoever in respect thereof or to the return of
the retained Card. LTA, SimplyGo and/or Operators shall be under no further obligation to entertain any such claim and the Card shall be deemed lost
and/or abandoned.
4.7 For the avoidance of doubt, nothing herein shall be construed as to relieve or release the Card Holder in any way of his/her liability under law (including, without limitation, the payment of any penalty fee, as may from time to time
be prescribed by PTC.
5. Customer Claims
5.1 A Card Holder may claim a refund from SimplyGo for any excess Fare which may have been deducted from a Card (including in circumstances where an expected reduction of fares was not given although the Transit Conditions for a concession or reduction (as the case may be) have been met), provided
that such claim is made within fourteen (14) calendar days of the incident (for EZ-Link, NETS FlashPay and SimplyGo EZ-Link/Concession Card) and sixty
(60) calendar days of the incident (for Bank Card).
6. Exclusion/Limitation of Liability
6.1 Neither LTA, SimplyGo nor any Operator (or any of their respective officers, employees or agents) shall be liable for any losses, damages, expenses,
claims, liability and costs (including cost on a solicitor and client basis) that a Card Holder may incur or suffer in connection with:
(a) the use of any Card and/or as a means of Fare Payment in the Public Transport System;
(b) any delay in the issuance of any Card or in the case of any retained Card, the return of such Card;
(c) the retention, suspension, discontinuance or revocation of any Card;
(d) any breakdown or fault in the Fare System; or
(e) any damaged, corrupted, defective faulty Card.
6.2 Without prejudice to Clause 6.1 above, should any liability be attributed to the LTA, SimplyGo and/or any Operator in connection with the use of any Card
and/or as a means of Fare payment in the Public Transport System
whatsoever, including but not limited to any event or incident arising from any negligence, LTA's, SimplyGo’s and such Operator's total liability to the Card Holder under these Conditions and at law shall not exceed in aggregate the
sum of $500.
7. Amendment
7.1 SimplyGo or LTA may from time to time amend, modify or vary any part of
these Conditions without any prior notice to Card Holders save that notice of any such amendments made shall be posted on the SimplyGo website and/or other premises as may be determined by SimplyGo or LTA. The Card Holder's continued use of the Card after the date of such notification shall constitute
an affirmative acknowledgement by the Card Holder of the amendments and shall be deemed to be the Card Holder's acceptance of the revised
Conditions.
8. No Waiver
8.1 No failure or delay on the part of SimplyGo, LTA or any Operator in exercising any power, right, or remedy under these Conditions shall operate as a waiver of such power, right, or remedy. Nor shall any single or partial exercise of any power, right, or remedy preclude the further or other exercise thereof, or the exercise of any power, right, or remedy that it may have.
9. Right of Third Parties
9.1 Any person or entity which is identified or referred to in these Conditions
(whether as a class of persons or otherwise) shall be deemed to be a party to these Conditions and shall accordingly be entitled to the benefit of, and to
enforce in its own right, any provision of these Conditions which may be
relevant to it or them to the fullest extent permitted by law. Save as aforesaid, the Contracts (Rights of Third Parties) Act 2001 shall not apply to give any
person or entity who is not a party to these Conditions any right to enforce any term of these Conditions. For the avoidance of doubt, nothing in this
Clause shall affect the rights of any permitted assignee or transferee of these Conditions.
10. Force Majeure
10.1 Neither SimplyGo, LTA nor any of the Operators shall be liable for any non- performance, error, interruption or delay in the performance of its or their
obligations under these Conditions if the same is due, in whole or in part, directly or indirectly to an event or failure which is beyond its or their
reasonable control including, without limitation:
(a) flood, lightning, acts of God, exceptional weather conditions, floods, droughts, storms, high winds, typhoons, fire, earthquakes and other natural disasters;
(b) impacts with or by air crafts or aerial objects, terrorism (whether actual or threatened), explosions, wars, warlike operations, hostilities,
insurgencies, invasions, epidemics, quarantines, acts of foreign or
public enemies, hijacking or unlawful seizure or wrongful exercise of control of vehicles, curtailment of transportation facilities, civil
commotion, riots, strikes or lock - outs on a city or industrial scale,
industrial disputes, industrial actions by workmen, shortage of labour, goods and materials;
(c) judgments, legislation, acts, orders, directives, policies, restrictions,
regulations, bye-laws, prohibitions or measures of any kind on the part of any court, governmental, parliamentary and/or regulatory authority imposed or to be imposed after the fact;
(d) power & telecommunication network failures;
(e) circumstances where communications lines and/or computer systems cannot be used for reasons attributable to any telecommunications
carriers; and
(f) acts or omissions of any third party.
11. Indemnity
11.1 The Card Holder hereby undertakes to indemnify and keep SimplyGo, LTA and each of the Operators harmless from and against any and all actions, proceedings, claims, liabilities (including statutory liability), penalties,
demands, costs (including without limitation, legal costs on a solicitor and
own client basis), awards, damages, losses and/or expenses however arising as may be directly or indirectly suffered or incurred by SimplyGo and/or the
Operators by reason of and/or as a result of any breach or non-compliance by the Card Holder of these Conditions.
12. Governing Law
12.1 The construction, validity and performance of these Conditions shall be governed by and construed in accordance with the laws of Singapore.

These terms and conditions issued by SimplyGo Pte. Ltd. (“SimplyGo”) governing the use of the EZ-Link Wallet incorporate any other terms and conditions which may be expressly stated in the Terms governing the use of the SimplyGo App. If there is any conflict or inconsistency between these Terms and other terms and conditions, these Terms will prevail.
The EZ-Link Wallet is a stored value wallet, where such stored value is capable of being used by the User (“you, your”) to perform purchases via QR Codes domestically in Singapore. Overseas usage may also be made available to you subject to further terms and conditions upon activation. You can also check the balance and view the transaction history of your EZ-Link Wallet from the SimplyGo App.
You acknowledge and agree that:

Notwithstanding the above, any transactions effected via your EZ-Link Wallet with Mastercard shall be deemed to have been done with your authorisation, and you shall be responsible for such transaction, unless we have ascertained that the transaction was done as a result of fraud.

The following terms and conditions govern when you add any EZ-Link Digital Wallet to a mobile digital wallet service (“Mobile Wallet Service”). The Mobile Wallet Service includes Google Pay or any other service permitted by SimplyGo Pte. Ltd. (“SimplyGo”) which allows the use of the Mobile Wallet in an electronic format for use with a Mobile Wallet Service via a mobile device. The use or continued usage of the Digitised Card on the Mobile Wallet by the Cardholder will constitute the Cardholder’s agreement to accept and be bound by the following terms and conditions.
The following terms and conditions are to be read together with Conditions of Issue and Use for EZ-Link Card at www.simplygo.com.sg. The Mobile Wallet Service T&Cs will prevail if there are any inconsistencies only in respect of the Mobile Wallet services.
In this Mobile Wallet T&Cs:
1.1 “Biometric Technology” refers to the usage of biometric data, e.g., facial map, fingerprint, palm print and other biometric data to recognise the Cardholder, authenticate their identity, and authorise their transactions;
1.2 “Account Holder” shall be defined as the person who is using the Unified Mobile Application;
1.3 “Digitised Card” means an electronic format of the account-based card enrolled and stored in the Cardholder’s Mobile Wallet within their Mobile Device to effect transactions at applicable terminals;
1.4 “Mobile Wallet Service” means the electronic payment services offered by a third party Mobile Wallet Provider using the Cardholder’s Mobile Device;
1.5 “Mobile Wallet Provider” means a provider of the electronic payment services using the Cardholder’s Mobile Device, subject to the terms and conditions set forth by Google Pay or Apple Pay with respect to the use of the Mobile Wallet;
1.6 “Intellectual Property Rights” refer to rights including all patents, trade secrets, copyrights, trademarks and moral rights;
1.7 “Merchant” means designated merchants who accept payment for goods and/or services via the Mobile Wallet, which may include merchants’ physical locations, e-commerce locations, and in-app purchases;
1.8 “Mobile Device” means a designated and eligible electronic device, permitted by SimplyGo to support the use of the Mobile Wallet and Digitised Card. The type or model of eligible Mobile Device is subject to change or cancellation by SimplyGo from time to time without prior notice. SimplyGo does not warrant that any device will be able to work in conjunction with the Mobile Wallet as this may be dependent on manufacturer’s requirements or types of software versions;
1.9 “QR Code” means the two-dimensional barcode which may be used by a Cardholder to effect payments in connection with a Mobile Wallet transaction, i.e., through a QR Code displayed by a Merchant;
1.10 “Third Party” or “Third Parties” mean sub-contractors, agents, and affiliates, or other third parties supporting the Mobile Wallet, and/or the applicable Card network, the Cardholder’s wireless carrier and mobile network operator.
2.1 Using the instructions provided by the Mobile Wallet Provider, the Cardholder may enrol a Digitised Card in a Mobile Wallet.
2.2 Prior to the Digitised Card being added to their Mobile Wallet, the Account Holder may be required to provide additional information, such as identifying or biometric information for authentication purposes.
2.3 Biometric Technology may be used by some Mobile Wallets to authorise transactions. As such Biometric Technology is not provided by SimplyGo, SimplyGo offers no representations or warranties regarding the security of the Biometric Technology as represented by the Mobile Wallet.
2.4 The Account Holder is required to provide accurate personal data required by SimplyGo through MyInfo or such other approved channels for the purposes of compliance with Monetary Authority of Singapore (MAS) anti-money laundering and counter-terrorist financing regulations.
2.5 The Cardholder may not be able to use a Mobile Wallet in all locations where the Digitised Card is accepted, thus the Digitised Card may not be able to be used for all the features and functionalities of a Mobile Wallet.
3.1 A Digitised Card can be used through a Mobile Wallet on a Mobile Device to make contactless payments at Merchants’ points-of-sale that accept contactless payments, or for digital commerce payments or in-app purchases.
3.2 The Cardholder’s transactions will be charged to the Digitised Card that was used for enrolment of the Digitised Card. This Mobile Wallet T&Cs incorporates the terms and conditions in the applicable agreement that governs the Digitised Card (including interest, fees, and charges), as amended from time to time, and remain applicable when a Digitised Card is enrolled in a Mobile Wallet. When transacting through a Mobile Wallet, the Cardholder is advised to review all applicable agreements for important information about their rights and responsibilities.
3.3 Whenever the Cardholder places their Digitised Card or Mobile Wallet near a Merchant’s contactless-enabled point-of-sale terminal/reader or uses it for any in-app purchase or digital commerce payments, the Cardholder shall be deemed to have authorised all payment transactions for a Merchants’ goods or services through a Mobile Wallet. By using Biometric Technology with a Mobile Wallet, the Cardholder acknowledges that they are authorising a transaction on their Digitised Card.
3.4 The Cardholder may utilise a Mobile Wallet to scan a Merchant’s QR Code to effect payments where applicable.
3.5 Mobile Wallet transactions may require the Cardholder to verify their identity as the Cardholder via a method determined by the Card network.
3.6 The Cardholder may need to accept additional terms and conditions from a Mobile Wallet Provider or an applicable mobile carrier in order to use a Mobile Wallet.
3.7 The Cardholder acknowledges that where applicable, transaction history displayed in a Mobile Wallet in connection with the use of a Digitised Card in that Mobile Wallet solely represents SimplyGo’s acknowledgement of the Cardholder’s Mobile Wallet transactions and does not reflect any post-authorisation activity, including but not limited to clearing, settlement, foreign currency exchange, refunds, reversals, returns or chargebacks.
3.8 In addition, the Cardholder acknowledges that the purchase amount, currency and other details featured in a Digitised Wallet’s transaction history in relation to the use of a Digitised Card may differ from that the transaction amount that is eventually cleared, settled, and posted to the Card’s billing statement.
4.1 The Cardholder is solely responsible for maintaining the confidentiality of their Mobile Wallet login information, including their username and/or password associated with their Mobile Device or Mobile Wallet, their fingerprint, or any other biometric data stored in their Mobile Device or any cloud storage platform, and the security of their Mobile Device to prevent loss, theft or fraudulent use.
4.2 If the Cardholder is no longer the owner of a Mobile Device associated with their Digitised Card and Mobile Wallet or does not intend to continue using their Digitised Card, they shall be responsible for deleting their Digitised Card and Mobile Wallet login Information from that Mobile Device.
4.3 In the event of loss, theft or disclosure of any Mobile Wallet login information, the Cardholder will be responsible for all transactions made by any unauthorised person until SimplyGo is notified of such loss, theft or disclosure.
4.4 In the event that the Cardholder permits another person to provision their Digitised Card into a Mobile Wallet, they may be responsible for any unauthorised charges made on their Digitised Card, either in whole or in part.
4.5 SimplyGo shall not be held liable for any loss or damages suffered or incurred by the Cardholder arising or resulting therefrom.
5.1 The Cardholder may suspend, report loss or terminate the use of their Digitised Card through a Mobile Wallet or report loss of their Mobile Device in such manner as specified by SimplyGo from time to time.
5.2 The Cardholder shall continue to be liable for the use of the Mobile Wallet services via the relevant Digitised Card and all charges arising therefrom notwithstanding the deletion or termination of the relevant Digitised Card. No request to terminate the use of the relevant Digitised Card shall be effective unless and until the relevant Digitised Card is deleted or otherwise terminated or disposed of in such manner as SimplyGo or the Mobile Wallet Provider may direct.
6.1 The Cardholder acknowledges and agrees that SimplyGo may disclose particulars as set out in Section 4.1 and certain details of their transactions made with Merchants via use of their Digitised Card to the Mobile Wallet Provider, the Mobile Wallet Provider’s its Third Parties supporting that Mobile Wallet, and the applicable Card network (e.g., MasterCard International Incorporated and its affiliates Maestro), as well as such Card network’s sub-contractors, agents and affiliates.
6.2 SimplyGo shall not be responsible for the privacy and security of any personal information (including biometric information) which the Cardholder may provide to and/or is held by the Mobile Wallet Provider, the applicable Card network, or other Third Parties supporting that Mobile Wallet. The Cardholder acknowledges that such collection, disclosure, and use will be subject to the privacy policies of such parties and not SimplyGo’s Privacy Policies.
7.1 This Mobile Wallet T&Cs govern the Cardholder’s use of their Digitised Card. The Cardholder may be subject to additional terms and conditions for the use of the Mobile Wallet with other Third Parties, including but not limited to the Mobile Wallet Provider, its Third Parties, the applicable Card network and the Cardholder’s wireless carrier and mobile network operator. The Cardholder is subject to these Third Parties’ terms and conditions for using the use of their services. It is the Cardholder’s responsibility to read and understand the Third Parties’ terms and conditions. In the event the Cardholder agrees to any Third Parties’ terms and conditions in order to use the Mobile Wallet services, SimplyGo shall not be responsible or liable.
7.2 SimplyGo makes no representations, warranties or conditions relating to a Mobile Wallet of any kind, and in particular, SimplyGo does not warrant or guarantee the operability or functionality of the Cardholder’s Mobile Wallet or that the Mobile Wallet will be available to complete a transaction and/or that any particular Merchant will accept the Cardholder’s Digitised Card through a Mobile Wallet.
7.3 SimplyGo shall not be responsible for the Cardholders’ use of the Mobile Wallet or any service, software, hardware or other goods or services provided by the Mobile Wallet Provider to the Cardholder, or any Third Party engaged by the Mobile Wallet Provider. SimplyGo shall also not be responsible for the security, accuracy, legality, appropriateness or other aspect of the function or content of the Mobile Wallet Provider or any Third-Party’s goods or services.
7.4 SimplyGo does not operate the Mobile Wallet and will not be liable to the Cardholder for any circumstances which interrupt, prevent or otherwise affect the functioning of any Digitised Card with a Mobile Wallet, such as unavailability of the Mobile Wallet or wireless service, communications, network delays, limitations on wireless coverage, system outages or interruption of a wireless connection.
7.5 All matters including delivery of goods and services, returns and warranties are solely between the Cardholder and the applicable Merchants, subject to applicable law and the applicable Card agreement. The Cardholder acknowledges that SimplyGo does not endorse or warrant the Merchants that are accessible through a Mobile Wallet.
The Cardholder shall indemnify and keep full indemnified SimplyGo (and its employees, directors, agents, affiliates and representatives) at all times against all claims, liabilities, costs (including legal costs on an indemnity basis), expenses, damages, losses including any direct losses, judgements, tax assessments, penalties and all interest, penalties and other reasonable costs and expenses suffered or incurred by SimplyGo arising from any breach of this Mobile Wallet T&Cs, as well as any actions or omissions of the Cardholder relating to:
(a) any actual or alleged breach of the Cardholder’s representations, warranties, or obligations set forth in this Mobile Wallet T&Cs, including any violation of SimplyGo’s policies;
(b) the Cardholder’s wrongful or improper use of a Mobile Wallet, including wilful misconduct or fraud;
(c) the Cardholder’s violation of any third party right, including without limitation any right of privacy, publicity rights or Intellectual Property Rights;
(d) the Cardholder’s violation of any law, rule or regulation of Singapore or any other country; and
(e) any other person’s unauthorised access or use of a Mobile Wallet with the Cardholder’s PIN, biometric authentication or other appropriate security code.
The Cardholder represents and warrants that:
(a) the Digitised Card they added to a Mobile Wallet is their Digitised Card;
(b) they and all transactions initiated by them will comply with all local laws, rules and regulations applicable to them, including any applicable tax laws and regulations;
(c) they will not use their Digitised Card through a Mobile Wallet for any fraudulent undertaking or in any manner so as to interfere with the operation of a Mobile Wallet; and
10.1 SimplyGo may amend this Mobile Wallet T&Cs at any time by posting the updated Mobile Wallet T&Cs in its mobile application or on its website, or by notifying the Cardholder through any other means as SimplyGo may determine. The Cardholder is bound by such revisions and should therefore review the current Mobile Wallet T&Cs as posted by SimplyGo in its mobile application or on its website from time to time.
10.2 By retaining the Digitised Card in the Mobile Wallet or continuing use of the Digitised Card after SimplyGo’s posting or notifying the Cardholder of the updated Mobile Wallet T&Cs, the Cardholder shall be deemed to have accepted the updated Mobile Wallet T&Cs.
11.1 Any delay or failure by SimplyGo to exercise its rights and/or remedies under this Mobile Wallet T&Cs or under any charge does not represent a waiver of any of its rights. SimplyGo shall be considered to have waived its rights only if it specifically notifies the Cardholder of such a waiver in writing.
12.1 This Mobile Wallet T&Cs is subject to Singapore law and the Cardholder hereby submits to the non-exclusive jurisdiction of the courts of Singapore.
13.1 A person who is not a party to this Mobile Wallet T&Cs may not enforce this Mobile Wallet T&Cs under the Contracts (Rights of Third Parties) Act 2002. Notwithstanding any term of this Mobile Wallet T&Cs, the consent of any third party is not required to vary, release or compromise any liability, or terminate any of the terms in this Mobile Wallet T&Cs.

1 DEFINITIONS AND INTERPRETATION
1.1 In these terms and conditions (“Terms and Conditions”), the following words and expressions shall have the meaning ascribed to them:
“Account” means any account which has been authorised by the Account Holder to enable SimplyGo to make deductions in respect of the provision of the Auto Top-up by Card Facility.
“Account Holder” in relation to any Account means the person to whom the Account belongs to.
“Application Form” means the form for the application of the Auto Top-up by Card Facility and includes any such form issued and/or submitted via electronic means for purposes of application for the Auto Top-up by Card Facility.
“Auto Top-up by Card Enabled ez-link card” means an ez-link card that has been enabled with the Auto Top-up by Card Facility.
“Auto Top-up by Card Facility” means the auto top-up service on ez-link cards provided by SimplyGo where ez-link cards are revaluated for a pre-selected amount automatically when the Stored Value on the ez-link card is equal or below the Threshold Value, and paid for by the Account Holder through the debiting of payments from the Account, and “Auto Top-up by Card” means any top-up transaction carried out on an ez-link card using the Auto Top-up by Card Facility.
“Card” means any credit, debit or charge card branded by VISA or MasterCard (or any other card association as may be stipulated by SimplyGo from time to time), and issued by any bank, financial institution or corporation, which may be used by the Account Holder as a means of payment for goods and/or services.
“Card Holder” means the person bearing and using the Auto Top-up by Card Enabled ez-link card.
“Convenience Fee” means a fee of $0.25 (or such other amount as may be determined by SimplyGo from time to time) charged to the Account Holder’s Account for each Revaluation service performed by SimplyGo.
“Card Issuer” means the bank or financial institution issuing the Card.
“ez-link card” for the purposes of these Terms and Conditions means the CEPAS “ez-link” branded stored-value facility issued by SimplyGo and used by the Card Holder for the payment of goods and services, and excludes any ez-link card that has been upgraded.
“Revalue” or “Revaluation” means adding the Revaluation Amount to the ez-link card through the use of a Revaluation Device.
“Revaluation Amount” means the amount specified by the Account Holder to be charged to his Account for the purposes of revaluating Auto Top-up by Card Enabled ez-link cards issued to Card Holders.
“Revaluation Device” means a bus ez-link card processor, a MRT/LRT Fare Gate or any other designated device for the Revaluation of the Auto Top-up by Card Enabled ez-link cards.
“SimplyGo” means SimplyGo Pte. Ltd. a company incorporated in Singapore providing the Auto Top-up by Card Facility.
“Stored Value” means the initial monetary value paid for and stored in an ez-link card or the residual value remaining therein from time to time.
“Threshold Value” means that the Stored Value of the Auto Top-up by Card Enabled ez-link card has reached zero value or negative.
“Ticket Office” means the ticket sales office located in MRT Stations and Bus Interchanges operated by SimplyGo and/or other agents appointed by SimplyGo for the purpose of providing sales, revaluation, replacement, and refund services for ez-link cards, including Auto Top-up by Card Enabled ez-link cards.
1.2 Words importing the singular shall include the plural and vice versa, words importing a gender shall include every gender.
1.3 The Terms and Conditions for Auto Top-up by Card Facility is in addition to and shall be read in conjunction with the Conditions of Issue and Use For ez-link Cards issued by SimplyGo.
2 CONDITIONS OF ISSUE
2.1 The Account Holder shall submit to SimplyGo a duly completed Application Form using electronic means or such other means approved by SimplyGo from time to time to apply for the Auto Top-up by Card Facility. Upon approval by SimplyGo, the ez-link card(s) nominated by the Account Holder will be enabled with the Auto Top-up by Card Facility. The Account Holder may nominate up to a maximum of seven (7) ez-link cards to be enabled with the Auto Top-up by Card Facility. SimplyGo shall not be obliged to approve any Application Form and shall not be obliged to furnish any reasons for any rejected Application Form.
2.2 In consideration of provision of the Auto Top-up by Card Facility by SimplyGo, the Account Holder hereby agrees:
2.2.1 that the Terms and Conditions shall be binding on the Account Holder in respect of all matters in relation to the use of the Auto Top-up by Card Enabled ez-link card;
2.2.2 that the Account Holder shall ensure that Auto Top-up by Card Enabled ez-link card(s) shall only be used by persons authorised by the Account Holder;
2.2.3 that SimplyGo shall be entitled to obtain and hold a pre-authorisation (“Pre-authorisation”) equivalent to the Revaluation Amount and Convenience Fee from the Card Issuer and will be held by SimplyGo for a period of 7 calendar days to be applied towards any pending Revaluation when the Stored Value of the Auto Top-up by Card Enabled ez-link card reaches a value of S$20.00 or less. The Account Holder acknowledges that the Pre-authorisation will not be available for use from the Account until either the Pre-authorisation is applied towards the Revaluation or where SimplyGo releases the Pre-authorisation back to the Card Issuer if no Revaluation occurs within the 7 calendar days. The Account Holder acknowledges that notwithstanding that SimplyGo has released the Pre-authorisation, the amount will only be available for the Account Holder’s use after the Card Issuer has effected the release of the amount into the Account;
2.2.4 that SimplyGo shall be entitled to inform the Card Issuer of the successful Revaluation and that the Card Issuer shall be entitled to charge the Account pursuant to the use of the Auto Top-up by Card Facility;
2.2.5 that SimplyGo shall be entitled to inform the Card Issuer to credit the Account with any monies that may be due from SimplyGo to the Account Holder in respect of refund of monies by SimplyGo to the Account Holder pursuant to these Terms and Conditions or otherwise;
2.2.6 that SimplyGo shall be entitled to deduct a Convenience Fee from the Account for each Revaluation;
2.2.7 that SimplyGo shall be entitled to deduct from the Account any monies owing to SimplyGo in respect of any Revaluations done on ez-link cards nominated by the Account Holder; and
2.2.8 that SimplyGo shall be entitled to blacklist or otherwise invalidate any Auto Top-up by Card Enabled ez-link card where the Account Holder is in breach of these Terms and Conditions. This shall include but not limited to SimplyGo blacklisting and terminating the ez-link card.
2.3 Notwithstanding anything to the contrary herein contained, the Account Holder agrees that a minimum period of 24 hours must elapse between each Revaluation for each Auto Top-up by Card Enabled ez-link card. SimplyGo shall not be obliged to revalue the Auto Top-up by Card Enabled ez-link card with another Revaluation Amount until after the Account has been successfully debited for any previous Revaluation Amounts.
3 CONDITIONS OF USE
3.1 The Account Holder hereby undertakes as follows:
3.1.1 to ensure that the Terms and Conditions contained herein and in the Conditions of Issue and Use For ez-link Cards are adhered to by the Card Holder where applicable;
3.1.2 to ensure that the Account is valid and there are sufficient funds or sufficient credit limit in the Account at all times in order to meet deductions by SimplyGo pursuant to the Auto Top-up by Card Facility and in accordance with this Terms and Conditions;
3.1.3 to inform SimplyGo immediately of any closure or termination of the Account or change in the Account that may prevent SimplyGo from deducting from the Account the applicable Revaluation Amount and Convenience Fee for each Revaluation;
3.1.4 to provide SimplyGo with any information as may be reasonably requested by SimplyGo in relation to the issue, use and cancellation of the Auto Top-up by Card Enabled ez-link card, and the termination of the Auto Top-up by Card Facility, and to render any and all necessary assistance to SimplyGo and/or any agents appointed by SimplyGo in relation to any investigation relating to the use of the Auto Top-up by Card Enabled ez-link card;
3.1.5 to instruct SimplyGo to terminate the Auto Top-up by Card Facility prior to the closure or termination of the Account; and
3.1.6 save where the Auto Top-up by Card Enabled ez-link card has been reported lost and cancelled in accordance with paragraph 6.2, to be responsible for all transactions, including any Revaluation, made by the use or purported use of the Auto Top-up by Card Enabled ez-link card by any person whether with or without the knowledge or consent of the Account Holder.
4 PAYMENT
4.1 In the event that SimplyGo fails to receive payment for the Auto Top-up by Card Facility in respect of any Revaluation for any reason whatsoever, SimplyGo shall have the right to do any or all of the following:
4.1.1 Recover from the Account Holder the outstanding Revaluation Amounts and/or Convenience Fee plus all costs incurred (including legal costs on a full indemnity basis) for the recovery of payment from the Account Holder to SimplyGo. In addition, SimplyGo shall be entitled to recover any outstanding amounts due from the Account Holder via deduction from the remaining value contained in any other Auto Top-up by Card Enabled ez-link card (“Associated Card”) registered under the Account Holder.
4.1.2 For the purpose referred to in paragraph 4.1.1, SimplyGo shall have the right to suspend the use of and/or terminate the use of the Auto Top-up by Card Enabled ez-link cards or any Associated Card.
4.1.3 Terminate the Auto Top-up by Card Facility pursuant to paragraph 7.3.2;
4.1.4 Disqualify the Account Holder from applying for, being considered for and/or successfully accepted under the Auto Top-up by Card Facility for any new ez-link cards for such length of time as may be determined to be appropriate by SimplyGo; and
4.1.5 Deduct or set-off any monies owing to SimplyGo from the remaining value in respect of any Auto Top-up by Card Enabled ez-link cards issued or held in respect of that Account or the Account Holder.
4.1.6 SimplyGo shall contact the Account Holder to arrange to refund of any excess money (free of interest) remaining in the Auto Top-up by Card Enabled ez-link cards after recovery of all monies owing to SimplyGo.
4.1.7 SimplyGo shall not be obligated to bear the cost of any replacement ez-link card where the Auto Top-up by Card Enabled ez-link cards has been terminated under this Terms and Conditions.
5 LIMIT OF LIABILITY
The provisions relating to exclusion of liability in the Conditions of Issue and Use For ez-link Cards shall apply in full to the use of any Auto Top-up by Card Enabled ez-link cards.
6 LOSS OF EZ-LINK CARD
6.1 It is the responsibility of the Account Holder to report the loss of any Auto Top-up by Card Enabled ez-link card (“Lost ez-link Card”) to SimplyGo at its hotline with one or more of the following information:
• Name of the Account Holder.
• NRIC or passport number of the Account Holder.
• Engraved identification number of the affected Auto Top-up by Card Enabled ez-link card(s).
In the event that the Lost ez-link Card is discovered outside of the hotline operating hours, the Account Holder may leave a voice mail reporting the loss with the above details. SimplyGo will attend to the loss report the next working day.
6.2 After a loss report has been reported in accordance with paragraph 6.1, SimplyGo shall block the lost Auto Top-up by Card Enabled ez-link Card within 48 hours. SimplyGo shall refund to the Account Holder’s Card the remaining Stored Value on the lost ez-link card (if any) within 9 days from the date of blocking for CEPAS Card.
6.3 Until the expiry of 48 hours after a Lost ez-link Card has been reported, the Account Holder shall be liable for any Revaluation to the Lost ez-link Card via the Auto Top-up by Card Facility as well as any deductions incurred on the ez-link card, and SimplyGo shall be entitled to deduct from the Account for the Revaluation performed. Where the Account Holder does not make a lost report to SimplyGo, the Account Holder shall continue to be liable for any deductions incurred or Revaluation occurring on the Lost ez-link Card.
6.4 The Account Holder shall not be liable for any Revaluation or deductions made on the Lost ez-link Card after the the expiry of 48 hours from the time of reporting loss of the ez-link Card.
6.5 Where the loss of an Auto Top-up by Card Enabled ez-link card has been reported, the Account Holder or Card Holder will have to re-apply for the Auto Top-up by Card Facility for the replacement ez-link card.
7 TERMINATION OF AUTO TOP-UP BY CARD FACILITY
7.1 The Account Holder may terminate the Auto Top-up by Card Facility by presenting the relevant Auto Top-up by Card Enabled ez-link card(s) at any Ticket Offices. The Account Holder shall pay all outstanding monies payable to SimplyGo prior to termination of the Auto Top-up by Card Facility. However, termination of the Facility is not allowed while an outstanding debit Amount is pending. Upon payment of the outstanding Amount, the Facility may then be terminated.
7.2 The Auto Top-up by Card Facility may be terminated by SimplyGo upon giving at least 7 days' written notice of the intention to terminate to the Account Holder.
7.3 Notwithstanding paragraph 7.2, SimplyGo reserves the right to terminate the Auto Top-up by Card Facility upon written notice to the Account Holder and the Bank in the event that:
7.3.1 there is a breach by the Account Holder or Card Holder in respect of any of the Terms and Conditions contained herein;
7.3.2 there is a failure to receive payment of monies owing to it as provided in paragraph 4;
7.3.3 the Account of the Account Holder is no longer valid; or
7.3.4 SimplyGo is unable to successfully deduct the Revaluation Amount and/or Convenience Fee from the Account.
7.4 Upon termination of the Auto Top-up by Card Facility howsoever, the Auto Top-up by Card Facility shall be disabled on the ez-link card, and:
7.4.1 Any and all monies due and owing to SimplyGo by the Account Holder in relation to the terminated Auto Top-up by Card Enabled ez-link card shall be paid within 2 weeks of the date of notification by SimplyGo (as the case may be) of the amount due and owing; and
7.4.2 Provided that SimplyGo shall have the right to set-off any monies owing to it from such remaining Stored Value.
7.5 Where the Account Holder owes any amount to SimplyGo in respect of the Auto Top-up by Card Facility services provided by SimplyGo, SimplyGo may in its discretion reject any further application to register any ez-link card for Auto Top-up by Card Facility until any amounts owing has been paid in full.
8 REFUND FOR SURRENDERED AUTO TOP-UP BY CARD ENABLED EZ-LINK CARDS
8.1 Account Holders who wish to surrender any Auto Top-up by Card Enabled ez-link card can do so at any Ticket Office or any other locations or channels designated by SimplyGo from time to time.
8.2 Any remaining value on the Auto Top-up by Card Enabled ez-link card, based on the amount as determined from SimplyGo’s computer records, will be refunded free of interest to the Account Holder and shall be credited to his Account within 14 working days of the date of surrender.
9 AMENDMENT
SimplyGo may from time to time amend any part of these Terms and Conditions as SimplyGo thinks fit. SimplyGo may give notice of any amendment by posting the amended Terms and Conditions at SimplyGo’s website (www.simplygo.com.sg) or at any Ticket Office at MRT and LRT stations and bus interchanges, and/or such other premises as may be determined by EZ-Link or by sending the Account Holder a notice, or by any method which SimplyGo thinks fit. The Card Holder agrees that any notification of amendments as aforesaid shall be sufficient notice for the purpose of this paragraph. The continued use of the Auto Top-up by Card Enabled ez-link card after the date of such notification shall constitute an affirmative acknowledgement by the Account Holder of the amendments and shall be deemed to be the Account Holder’s acceptance of such revised Terms and Conditions.
10 NOTICES
Unless otherwise provided herein all notices, demands or other communications by SimplyGo shall be in writing to the address of the Account Holder as stated in SimplyGo's records and shall be deemed served if
10.1 delivered by hand, on the day of delivery;
10.2 by ordinary post, on the day following that on which the notice was posted; or
10.3 by facsimile transmission, on the day the facsimile was transmitted.
11 NO WAIVER
No failure or delay on the part of SimplyGo or its agents in exercising any power right or remedy under the Terms and Conditions shall operate as a waiver of such power right or remedy, nor shall any single or partial exercise of any power right or remedy preclude the further or other exercise thereof, or the exercise of any power right or remedy which it may have.
12 RIGHT OF THIRD PARTIES
A person or entity who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act to enforce any term of these Conditions, regardless of whether such person or entity has been identified by name, as a member of a class or as answering a particular description. For the avoidance of doubt, nothing in this paragraph shall affect the rights of any permitted assignee or transferee of these Terms and Conditions.
13 LAW
The Terms and Conditions are governed by and shall be construed in accordance with the laws of Singapore. The Account Holder hereby submits to the exclusive jurisdiction of the Singapore courts.

1 DEFINITIONS AND INTERPRETATION
1.1 In these terms and conditions (“Terms and Conditions”), the following words and expressions shall have the meaning ascribed to them:
“Account” means the bank account designated by the Account Holder in the Application for the Auto Top-up by GIRO Facility and accepted by SimplyGo and the Bank for debiting of Revaluations via Auto Top-up by GIRO.
“Account Holder” means the person who has had an ez-link card enabled with the Auto Top-up by GIRO Facility by SimplyGo and whose Account will be debited in respect to automatic or customer activated Revaluations made to the Auto Top-up by GIRO Enabled ez-link card(s) held or issued to Cardholder(s) at his request.
“Application” means the application of the Auto Top-up by GIRO Facility and includes any such application via electronic means or otherwise for purposes of application for the Auto Top-up by GIRO Facility.
“Application Fee” means the $1.00 fee (or such other amount as determined by SimplyGo from time to time) payable by the Account Holder to SimplyGo for each application submitted for the Auto Top-up by GIRO Facility.
“Auto Top-up by GIRO Facility” or “Facility” means the auto top-up service of a nominated ez-link card whereby the ez-link card nominated by the Account Holder can be topped up for a pre-selected amount (and deducted from the Account) automatically by a public transport fare system device or such other devices authorised by SimplyGo when the remaining value in the ez-link card is equal or below a threshold value.
“Auto Top-up by GIRO Enabled ez-link card” means an ez-link card that has been nominated and enabled for Auto Top-up by GIRO.
“Bank” means any bank licensed to operate retail-banking services in Singapore and participating in the Auto Top-up by GIRO Facility.
“Card Holder” in respect to a Auto Top-up by GIRO Enabled ez-link card refers to the Account Holder or a person nominated by the Account Holder in the Application for the Auto Top-up by GIRO Facility who is authorised to collect and use an Auto Top-up by GIRO Enabled ez-link card, linked to the Account, or the Holder of a Auto Top-up by GIRO Enabled ez-link card.
“Deduction” means the deduction of the Amount from the Account by the Bank and payable to SimplyGo upon each Revaluation.
“Deposit” means an amount equivalent to the Revaluation Amount which shall be deducted upon the successful application of the Auto Top-up by GIRO Facility for each Auto Top-up by GIRO Enabled ez-link card, and which shall be held by SimplyGo, and in the event the Deduction by the Bank of the Revaluation Amount from the Account is unsuccessful, such Deposit may be applied by SimplyGo towards settlement of the Revaluation Amount which has been topped-up onto the ez-link card.
“ez-link card” for the purposes of these Terms and Conditions means the CEPAS “ez-link” branded stored value facility issued by SimplyGo for the payment of goods and services, and excludes any ez-link card that has been upgraded,
“Public transport fare system device” means a bus contactless smartcard Processor, a MRT Fare Gate or a LRT Fare Gate.
“Revaluation” means adding stored value to the ez-link card via the Auto Top-up by GIRO Facility.
“Revaluation Amount” means the amount specified by the Account Holder in the Application to be deducted from his Account for the purposes of topping up the Auto Top-up by GIRO Enabled ez-link card issued to Card Holders, or the amount as may be subsequently changed by the Account Holder.
“SimplyGo” refers to SimplyGo Pte. Ltd., the issuer of the ez-link card and the provider of the Auto Top-up by GIRO Facility.
“Ticket Office” means an office located in MRT Stations and Bus Interchanges operated by SimplyGo or an authorised agent of SimplyGo for the purpose of providing sales, top-ups, replacement, and refund services for ez-link cards, including Auto Top-up by GIRO Enabled ez-link cards.
1.2 Words importing the singular shall include the plural and vice versa, words importing a gender shall include every gender.
1.3 The Terms and Conditions for the Use of Auto Top-up by GIRO Facility are in addition to the Conditions of Issue and Use Of EZ-Link Cards issued by SimplyGo. In the event of any inconsistency between the Terms and Conditions contained herein and the Conditions of Issue and Use Of EZ-Link Cards, the Terms and Conditions herein shall prevail.
2 CONDITIONS OF USE
2.1 Any Account Holder may upon approval by the Bank and SimplyGo have his nominated ez-link card(s) enabled with the Auto Top-up by GIRO Facility.
2.2 In consideration of the enabling of the nominated ez-link card(s) with the Auto Top-up by GIRO Facility by SimplyGo, the Account Holder hereby agrees:
2.2.1 that SimplyGo is authorized to deduct from the Account the applicable Deposit for each Auto Top-up by GIRO Enabled ez-link card;
2.2.2 that the Terms and Conditions shall be binding on the Account Holder in respect of all matters in relation to the use of the Auto Top-up by GIRO Facility and the Auto Top-up by GIRO Enabled ez-link card;
2.2.3 that SimplyGo and the Bank shall be entitled to establish the proper linkage between the Account and the said Auto Top-up by GIRO Enabled ez-link card;
2.2.4 that SimplyGo shall be entitled to authorise the Bank and that the Bank shall be entitled to debit the Account pursuant to the use of the Auto Top-up by GIRO Facility;
2.2.5 to pay the Application Fee to SimplyGo for each ez-link card enabled with the Auto Top-up by GIRO Facility.
2.2.6 that SimplyGo shall be entitled to authorise the Bank and that the Bank shall be entitled to credit the Account with any monies that may be due from SimplyGo to the Account Holder in respect of refund of monies by SSimplyGo to the Account Holder pursuant to the Terms and Conditions or otherwise.
2.3 Notwithstanding anything to the contrary herein contained, the Account Holder agrees that a minimum period, to be determined by SimplyGo, must elapse between each Revaluation of the Auto Top-up by GIRO Enabled ez-link card. SimplyGo shall not be obliged to Revalue the Auto Top-up by GIRO Enabled ez-link card with another Revaluation Amount until after the Account has been successfully debited for any previous Revaluation Amounts.
3 UNDERTAKING BY ACCOUNT HOLDER
3.1 The Account Holder hereby undertakes as follows:
3.1.1 to ensure that the Terms and Conditions contained herein and in the Conditions of Issue and Use of EZ-Link Cards are adhered to by the Card Holder where applicable;
3.1.2 to maintain at all times a sufficient balance in his Account to enable the Bank to make the requisite debits in respect of the use of the Auto Top-up by GIRO Facility;
3.1.4 to provide SimplyGo with any information as may be reasonably requested by SimplyGo in relation to the use and cancellation of the Auto Top-up by GIRO Facility, and the termination of the Auto Top-up by GIRO Facility, and to render any and all necessary assistance to SimplyGo in relation to any investigation relating to the use of the Auto Top-up by GIRO Facility; and
3.1.5 subject to paragraph 6.2, to be responsible for all transactions made by the use or purported use of the Auto Top-up by GIRO Enabled ez-link cards by any person whether with or without the knowledge or consent of the Account Holder.
4 PAYMENT
4.1 In the event that SimplyGo fails to receive payment in respect of any monies to be debited from the Account for any reason whatsoever, SimplyGo shall have the right to do any or all of the following:
4.1.1 Deduct from the Deposit to settle the Revaluation Amount effected onto the Auto Top-up by GIRO Enabled ez-link card and owing to SimplyGo, and in addition to authorize SimplyGo to further deduct an amount equivalent to the Revaluation Amount in order to maintain the Deposit for the purposes of the Auto Top-up by GIRO Facility.
4.1.2 Impose on the Account Holder an administrative charge (“Administrative Fee”) of $2.00 for each unsuccessful Deduction from the Account.
4.1.3 Suspend the use of all Auto Top-up by GIRO Enabled ez-link cards issued in respect of that Account and to reactivate the use of the said card(s) only upon the Account Holder’s settlement of all monies owed to SimplyGo, including the Top-Up Amount and Administrative Fee.
4.1.4 Terminate the use of any or all Auto Top-up by GIRO Enabled ez-link cards issued in respect of that Account and/or terminate the Auto Top-up by GIRO Facility pursuant to paragraph 7.3.2 and
4.1.5 Disqualify the Account Holder and/or the Card Holder(s) from applying for, being considered for and/or successfully accepted under the Auto Top-up by GIRO Facility for any new ez-link cards for such length of time as may be determined to be appropriate by SimplyGo.
4.1.6 Deduct or set-off any monies owing to SimplyGo from the remaining value paid in respect of any Auto Top-up by GIRO Enabled ez-link cards issued or held in respect of that Account or the Account Holder.
5 LIMIT OF LIABILITY
The provisions relating to exclusion of liability in the Conditions of Issue and Use Of EZ-Link cards shall apply in full to the use of any Auto Top-up by GIRO Enabled ez-link cards.
6 LOSS OF AUTO TOP-UP BY GIRO ENABLED EZ-LINK CARDS
6.1 It is the responsibility of the Account Holder or Card Holder(s) to report the loss of any Auto Top-up by GIRO Enabled ez-link cards to SimplyGo via the SimplyGo mobile app or the SimplyGo customer service hotline with one or more of the following information:
• Name of the Account Holder.
• NRIC or passport number of the Account Holder.
• Engraved identification number of the affected Auto Top-up by GIRO Enabled ez-link card(s).
6.2 After a loss report has been reported in accordance with paragraph 6.1, SimplyGo shall block the lost Auto Top-up by GIRO Enabled ez-link Card within 48 hours in the case of CEPAS Card. SimplyGo shall refund to the Account Holder’s bank account the remaining Stored Value on the lost ez-link card (if any) and the Deposit (less any deductions) within 9 days from the date of blocking for CEPAS Card.
6.3 The Account Holder shall not be liable for any Revaluation or deductions made on the Lost ez-link Card after the Lost ez-link Card has been blocked.
6.4 Where the loss of an Auto Top-up by GIRO Enabled ez-link cards has been reported, the Account Holder or Card Holder will have to re-apply for the Auto Top-up by GIRO Facility for the replacement ez-link card.
7 TERMINATION OF AUTO TOP-UP BY GIRO FACILITY
7.1 The Account Holder may terminate the Auto Top-up by GIRO Facility by presenting the relevant Auto Top-up by GIRO Enabled ez-link card(s) at or any Ticket Offices. The Account Holder shall pay all outstanding monies payable to SimplyGo prior to termination of the Auto Top-up by GIRO Facility. However, termination of the facility is not allowed while an outstanding debit Amount is pending. Upon payment of the outstanding Amount, the facility may then be terminated.
7.2 SimplyGo reserves the right to terminate the Auto Top-up by GIRO Facility in the event that:
7.2.1 there is a breach by the Account Holder or Card Holder in respect of any of the Terms and Conditions contained herein; or
7.2.2 there is a failure to receive payment of monies owing to it as provided in paragraph 4.
7.2.3 the Account of the Account Holder is no longer valid; or
7.2.4 SimplyGo is unable to successfully deduct the Revaluation Amount from the Account.
7.3 Upon termination of the Auto Top-up by GIRO Facility by SimplyGo, the Auto Top-up by GIRO Facility shall be disabled on the ez-link card, and:
7.3.1 All monies due and owing to SimplyGo by the Account Holder in relation to the terminated Auto Top-up by GIRO Enabled ez-link cards shall be paid within 2 weeks of the date of notification by SimplyGo of the amount due and owing; and
7.3.2 The remaining value paid on the Auto Top-up by GIRO Enabled ez-link cards shall remain on the ez-link card;
7.3.3 Provided that SimplyGo shall have the right to set-off any monies owing to it from such remaining Stored Value on the ez-link card.
8 REFUND FOR SURRENDERED AUTO TOP-UP BY GIRO ENABLED EZ-LINK CARDS
8.1 Card Holders of Auto Top-up by GIRO Enabled ez-link cards who wish to surrender their ez-link cards, can do so at any Ticket Office or any other locations or channels designated by SimplyGo from time to time.
8.2 The value remaining, if any, of the Auto Top-up by GIRO Enabled ez-link cards, based on the amount as determined from SimplyGo’s computer records including the Deposit (less any deductions), will be refunded free of interest to the Account Holder and shall be credited to his Account within 14 working days of the date of surrender.
9 AMENDMENT
SimplyGo may from time to time amend any part of these Terms and Conditions. SimplyGo will give notice of any amendment by posting the amended Terms and Conditions at on the SimplyGo website at www.simplygo.com.sg. The Card Holder agrees that any notification of amendments as aforementioned shall be sufficient notice for the purpose of this paragraph. If the Card Holder does not accept any amendments, he shall cease all use of the ez-link card. The Card Holder’s continued use of the ez-link card after the date of such notification shall constitute an affirmative acknowledgement by the Card Holder of the amendments and shall be deemed to be the Card Holder’s acceptance of such revised Terms and Conditions.
10 NOTICES
Unless otherwise provided herein all notices, demands or other communications by SimplyGo shall be in writing to the address of the Account Holder as stated in SimplyGo's records and shall be deemed served if
10.1 delivered by hand, on the day of delivery;
10.2 by ordinary post, on the day following that on which the notice was posted;
10.3 by SMS, mobile app push notification or email, on the day of delivery or
10.4 by facsimile transmission, on the day the facsimile was transmitted.
11 NO WAIVER
No failure or delay on the part of SimplyGo, its agents, or any service provider in exercising any power right or remedy under the Terms and Conditions shall operate as a waiver of such power right or remedy. Nor shall any single or partial exercise of any power right or remedy preclude the further or other exercise thereof, or the exercise of any power right or remedy which it may have.
12 RIGHT OF THIRD PARTIES
A person or entity who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act to enforce any term of these Conditions, regardless of whether such person or entity has been identified by name, as a member of a class or as answering a particular description. For the avoidance of doubt, nothing in this paragraph shall affect the rights of any permitted assignee or transferee of these Terms and Conditions.
13 LAW
The Terms and Conditions are governed by and shall be construed in accordance with the laws of Singapore. The Account Holder hereby submits to the non-exclusive jurisdiction of the courts of Singapore.

1 DEFINITIONS AND INTERPRETATION
1.1 The Auto Top-up Service referred to in this terms and conditions (“Terms and Conditions”) shall be applicable to any upgraded ez-link branded cards issued under the Conditions of Issue and Use for ez-link Card. This Auto Top-up Service shall not apply to any CEPAS compliant ez-link card unless the said card has been upgraded.
1.2 In these terms and conditions (“Terms and Conditions”), the following words and expressions shall have the meaning ascribed to them:
“Account” means any Auto Top-up account which has been registered by the Account Holder to enable SimplyGo to make deductions from the Source of Funds in respect of the provision of the Auto Top-up Service.
“Account Holder” in relation to any Account means the person to whom the Account belongs to.
“Application” means the application of the Auto Top-up Service and includes any such form that may be submitted via the SimplyGo Mobile App or other electronic means for purposes of application for the Auto Top-up Service.
“Auto Top-up Enabled Card” means any Card that is enabled by the Account Holder with the Auto Top-up Service.
“Auto Top-up Service” means the auto top-up service provided by SimplyGo where Cards are revaluated automatically for the Pre-selected Top-up Value (or multiples thereof) where the Stored Value is insufficient to complete the purchase, and which is paid for by the Account Holder through the debiting of payments from the Account.
“Card Holder” means the person bearing and using the Auto Top-up Enabled Card.
“Card” means the card (whether physical or digital) issued by SimplyGo and used by the Card Holder for the payment of goods and services, and for the purposes of these Terms and Conditions, refer to cards which have been enabled with the Auto Top-up Service.
“Funding Institution” means the bank, financial institution or entity that issues or operates the Source of Fund.
“Pre-selected Top-up Value” means the amount that is pre-selected by the Account Holder to be Revalued on the Card for each Auto Top-up transaction.
“Revalue” or “Revaluation” means adding the Revaluation Amount to the Card.
“Revaluation Amount” means the amount specified by the Account Holder to be charged to his Account for the purposes of revaluating Auto Top-up Enabled Cards issued to Card Holders.
“SimplyGo” means SimplyGo Pte. Ltd. a company incorporated in Singapore providing the Auto Top-up Service.
“SimplyGo Mobile App” means the SimplyGo mobile app that may be used by the Account Holder for enabling and managing Auto Top-up related services.
“Source of Funds” means any source of funds accepted by SimplyGo and linked to the Account for the purposes of funding the Auto Top-up Service, which include -
(a) payment card branded by VISA or MasterCard as may be accepted by SimplyGo;
(b) DBS bank account deduction via GIRO; and
(c) any other electronic wallets or accounts accepted by SimplyGo .
“Stored Value” means the residual value remaining on the Card.
“Threshold Value” means that the Stored Value of the Auto Top-up Enabled Card has reached such amount determined by SimplyGo as applicable for the relevant Card for triggering an Auto Top-up.
“Ticket Office” means the ticket sales office located in MRT Stations and Bus Interchanges operated by SimplyGo.
1.3 Words importing the singular shall include the plural and vice versa, words importing a gender shall include every gender.
1.4 The Terms and Conditions for Auto Top-up Service is in addition to and shall be read in conjunction with the Conditions of Issue and Use For ez-link Cards issued by SimplyGo. The Conditions of Issue and Use For ez-link cards are available at SimplyGo’s website at www.simplygo.com.sg.
2. CONDITIONS OF ISSUE
2.1 The Account Holder may register for Auto Top-up Service for a Card by submitting the Application using the SimplyGo Mobile App or such other electronic means approved by SimplyGo from time to time. Upon approval by SimplyGo, the Card(s) nominated by the Account Holder will be enabled with the Auto Top-up Service. The Account Holder may nominate up to a maximum number of Cards (such number to be determined by SimplyGo) to be linked to each Source of Funds for the Auto Top-up Service. SimplyGo shall not be obliged to approve any Application and shall not be obliged to furnish any reasons for any rejected Application.
2.2 In consideration of provision of the Auto Top-up Service by SimplyGo, the Account Holder hereby agrees:
2.2.1 that the Terms and Conditions shall be binding on the Account Holder in respect of all matters in relation to the use of the Auto Top-up Enabled Card;
2.2.2 that the Account Holder shall ensure that Auto Top-up Enabled Card(s) shall only be used by persons authorised by the Account Holder;
2.2.3 that the Account Holder shall be responsible for any usage transactions or Auto Top-ups performed on any Auto Top-up Enabled Card(s);
2.2.4 that in the event the Stored Value of the Auto Top-up Enabled Card reaches a low value threshold as determined by SimplyGo, the Account Holder authorises SimplyGo to request from the Funding Institution a deduction from the Account the amount to be applied towards any pending Revaluation, and upon successful deduction thereof, to effect the Revaluation onto the Auto Top-up Enabled Card. The Account Holder agrees that SimplyGo shall not effect the Revaluation where SimplyGo is unable, for any reason whatsoever, to make a successful deduction from the Account.
2.2.5 that SimplyGo shall be entitled to deduct from the Account any monies owing to SimplyGo in respect of any Revaluations done on any Cards nominated by the Account Holder;
2.2.6 that SimplyGo shall be entitled to terminate the Auto Top-up Service in relation to any Cards nominated by the Account Holder where the Account Holder is in breach of these Terms and Condtions;
2.2.7 that SimplyGo shall be entitled to blacklist or otherwise invalidate any Auto Top-up Enabled Card where the Account Holder is in breach of these Terms and Conditions. This shall include but not limited to SimplyGo blacklisting and terminating the Card; and
2.2.8 that the Account Holder such provide such correct and accurate personal information in such manner as may be required by SimplyGo in the Application.
2.3 Notwithstanding anything to the contrary herein contained, SimplyGo may impose a limit on the number of Revaluations per day for each Auto Top-up Enabled Card.
2.4 The Account Holder may via the SimplyGo Mobile App authorize and enable multiple Auto Top-ups of the Pre-selected Top-up Value in a single payment transaction to enable sufficient funds for a payment.
2.5 The Account Holder acknowledges that in the event that the Auto Top-up is successfully triggered the Account Holder shall be liable to pay for the Revaluation Amount credited to the Stored Value of the Card.
3 CONDITIONS OF USE
3.1 The Account Holder hereby undertakes as follows:
3.1.1 to ensure that the Terms and Conditions contained herein and in the Conditions of Issue and Use For ez-link Cards are adhered to by the Card Holder where applicable;
3.1.2 to ensure that the Source of Funds is valid and there are sufficient funds or sufficient credit limit in the Source of Funds at all times in order to meet deductions by SimplyGo pursuant to the Auto Top-up Service and in accordance with this Terms and Conditions;
3.1.3 to inform SimplyGo immediately of any closure or termination of the Account or change in the Source of Funds that may prevent SimplyGo from deducting from the Source of Funds the applicable Revaluation Amount for each Revaluation;
3.1.4 to provide SimplyGo with any information as may be reasonably requested by SimplyGo in relation to the issue, use and cancellation of the Auto Top-up Enabled Card, and the termination of the Auto Top-up Service, and to render any and all necessary assistance to SimplyGo and/or any agents appointed by SimplyGo in relation to any investigation relating to the use of the Auto Top-up Enabled Card;
3.1.5 to instruct SimplyGo to terminate the Auto Top-up Service prior to the closure or termination of any Source of Funds; and
3.1.6 save where the Auto Top-up Enabled Card has been reported lost and cancelled in accordance with paragraph 6.2, to be responsible for all transactions, including any Revaluation, made by the use or purported use of the Auto Top-up Enabled Card by any person whether with or without the knowledge or consent of the Account Holder.
3.2 The Account Holder agrees and acknowledges that:
3.2.1 The Auto Top-up Service will only be effected when the Application has been successfully approved by SimplyGo;
3.2.2 Upon the Auto Top-up Service being activated, the Account Holder will be liable for any Auto Top-up on any Auto Top-up Enabled Card until such time that the Account Holder has either successfully terminated the Auto Top-up Service via the SimplyGo Mobile App or informed SimplyGo to terminate the Auto Top-up Service in accordance with paragraph 7.1.
4 PAYMENT
4.1 In the event that SimplyGo fails to receive payment for the Auto Top-up Service in respect of any Revaluation for any reason whatsoever, SimplyGo shall have the right to do any or all of the following:
4.1.1 Recover from the Account Holder the outstanding Revaluation Amounts plus all costs incurred (including legal costs on a full indemnity basis) for the recovery of payment from the Account Holder to SimplyGo. In addition, SimplyGo shall be entitled to recover any outstanding amounts due from the Account Holder via deduction from the remaining value contained in any other SimplyGo product (“Associated Card”) registered under the Account Holder.
4.1.2 For the purpose referred to in paragraph 4.1.1, SimplyGo shall have the right to suspend the use of and/or terminate the use of the Auto Top-up Enabled Cards or any Associated Card.
4.1.3 Terminate the Auto Top-up Service pursuant to paragraph 7.2.2;
4.1.4 Disqualify the Account Holder from applying for, being considered for and/or successfully accepted under the Auto Top-up Service for any new Cards for such length of time as may be determined to be appropriate by SimplyGo; and
4.1.5 Deduct or set-off any monies owing to SimplyGo or any merchant from the remaining value in respect of any Auto Top-up Enabled Cards issued or held in respect of that Account or the Account Holder.
4.1.6 SimplyGo shall contact the Account Holder to arrange to refund of any excess money (free of interest) remaining in the Auto Top-up Enabled Cards after recovery of all monies owing to SimplyGo.
4.1.7 SimplyGo shall not be obligated to bear the cost of any replacement Card where the Auto Top-up Enabled Cards has been terminated under this Terms and Conditions.
5 LIMIT OF LIABILITY
The provisions relating to exclusion of liability in the Conditions of Issue and Use For ez-link Cards shall apply in full to the use of any Auto Top-up Enabled Cards.
6 LOSS OF CARD
6.1 It is the responsibility of the Account Holder to either block the usage of any lost Auto Top-up Enabled Card (“Lost Card”) via the SimplyGo Mobile App or report the loss of any Lost Card to SimplyGo at its hotline during the hours of 8.00 am to 6.00 p.m. (daily except public holiday). In the event that the Lost Card is discovered outside of the hotline operating hours, the Account Holder may leave a voice mail reporting the loss with the above details. SimplyGo will attend to the loss report the next working day.
6.2 SimplyGo shall cancel the Lost Card immediately after a Lost Card has been reported in accordance with paragraph 6.1. SimplyGo shall refund to the Account Holder the remaining Stored Value on the Lost Card (if any) within 7 days of the date of cancellation.
6.3 Where the Account Holder fails to disable the usage of the Auto Top-up Enabled Card via the SimplyGo Mobile App, or fails to a lost report of any Lost Card to SimplyGo, the Account Holder shall continue to be liable for any deductions incurred or Revaluation occurring on the Lost Card, whether with or without the Account Holder’s knowledge or consent.
6.4 The Account Holder shall not be liable for any Revaluation or deductions made on the Lost Card from the time of disabling of the use of the Lost Card via the SimplyGo Mobile App or loss report of the Card.
6.5 Where the loss of an Auto Top-up Enabled Card has been reported, the Account Holder or Card Holder will have to re-apply for the Auto Top-up Service for the replacement Card.
7 TERMINATION OF AUTO TOP-UP SERVICE
7.1 The Account Holder may terminate the Auto Top-up Service via the SimplyGo Mobile App or via such other means as may be authorised by SimplyGo. Auto Top-up. The Account Holder shall pay all outstanding monies payable to SimplyGo prior to termination of the Auto Top-up Service. However, termination of the Service is not allowed while an outstanding debit Amount is pending.
7.2 SimplyGo reserves the right to immediately terminate the Auto Top-up Service without written notice to the Account Holder and the Bank in the event that:
7.2.1 there is a breach by the Account Holder or Card Holder in respect of any of the Terms and Conditions contained herein;
7.2.2 there is a failure to receive payment of monies owing to it as provided in paragraph 4;
7.2.3 the Account of the Account Holder is no longer valid; or
7.2.4 SimplyGo is unable to successfully deduct the Revaluation Amount and/or Convenience Fee from the Account.
7.3 Upon termination of the Auto Top-up Service howsoever, the Auto Top-up Service shall be disabled on the Card, and:
7.3.1 Any and all monies due and owing to SimplyGo by the Account Holder in relation to the terminated Auto Top-up Enabled Card shall be paid within 2 weeks of the date of notification by SimplyGo (as the case may be) of the amount due and owing; and
7.3.2 Provided that SimplyGo shall have the right to set-off any monies owing to it from such remaining Stored Value of the Auto Top-up Enabled Card and/or Associated Card(s).
7.4 Where the Account Holder owes any amount to SimplyGo in respect of the Auto Top-up Service services provided by SimplyGo, SimplyGo may in its discretion reject any further application to register any Card for Auto Top-up Service until any amounts owing has been paid in full.
8 REFUND FOR SURRENDERED AUTO TOP-UP ENABLED CARDS
8.1 Account Holders who wish to surrender any Auto Top-up Enabled Card can do so at any Ticket Office or any other locations or channels designated by SimplyGo from time to time.
8.2 Any remaining value on the Auto Top-up Enabled Card, based on the amount as determined from SimplyGo’s computer records, will be refunded free of interest to the Account Holder within 14 working days of the date of surrender to the original Source of Fund.
9 AMENDMENT
SimplyGo may from time to time amend any part of these Terms and Conditions as SimplyGo thinks fit. SimplyGo may give notice of any amendment by posting the amended Terms and Conditions at SimplyGo’s website (www.simplygo.com.sg). The Card Holder agrees that any notification of amendments as aforesaid shall be sufficient notice for the purpose of this paragraph. The continued use of the Auto Top-up Enabled Card after the date of such notification shall constitute an affirmative acknowledgement by the Account Holder of the amendments and shall be deemed to be the Account Holder’s acceptance of such revised Terms and Conditions.
10 NOTICES
Unless otherwise provided herein all notices, demands or other communications by SimplyGo to a Account Holder shall be deemed served if sent -
10.1 by SMS to the Account Holder’s last known mobile number; or
10.2 by email to the Account Holder’s email.
11 NO WAIVER
No failure or delay on the part of SimplyGo or its agents in exercising any power right or remedy under the Terms and Conditions shall operate as a waiver of such power right or remedy, nor shall any single or partial exercise of any power right or remedy preclude the further or other exercise thereof, or the exercise of any power right or remedy which it may have.
12 RIGHT OF THIRD PARTIES
A person or entity who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act to enforce any term of these Conditions, regardless of whether such person or entity has been identified by name, as a member of a class or as answering a particular description. For the avoidance of doubt, nothing in this paragraph shall affect the rights of any permitted assignee or transferee of these Terms and Conditions.
13 LAW
The Terms and Conditions are governed by and shall be construed in accordance with the laws of Singapore. The Account Holder hereby submits to the exclusive jurisdiction of the Singapore courts.

1. The Auto Top-up Auto Top-up e-Statement Service (“Service”) is a value-add default service provided by SimplyGo Pte. Ltd. (“SimplyGo”) for users of Auto Top-up Auto Top-up by GIRO and Auto Top-up by Card who have registered their email address with SimplyGo. Please read and understand the Terms and Conditions for the Service as the use of the Service will constitute your agreement to and acknowledgement of these terms and conditions as well as the acknowledgement of all the inherent risks in the transmission of e-Statement via e-mail.
2. The provision of this Service is at SimplyGo’s discretion, and such Service may be modified, suspended, withdrawn, cancelled or discontinued by SimplyGo at any time.
3. You will receive the e-Statement only if you have activated the Auto Top-up accounts and have made top-up transaction through Auto Top-up by GIRO or Auto Top-up by Card.
4. Each bank or credit/debit card account will receive only one e-Statement per month.
5. You agree to release us from any liability whatsoever resulting from any unauthorised assess from any party to your e-Statement sent to your designated email address (“Designated Email”). You agree that SimplyGo cannot warrant the timeliness, security, confidentiality or availability in the transmission of the e-Statements to the Designated Email.
6. You may terminate the Service at any time by submitting a request via phone call to our call centre. On such request, SimplyGo shall remove your email address from our records as soon as possible. Do note that in such a time where your email address is again provided to SimplyGo for the purpose of facilitating the application, enquiry, termination or any other investigation purposes, your email address will be reinstated into our records.
7. You are required to check all e-Statements for any unauthorized transactions, and if you are aware of any unauthorized transaction(s) on any of the e-Statements, you must notify both SimplyGo and your bank as soon as reasonably practicable.
8. SimplyGo may from time to time advertise its products and services as well as those of its partners through the e-Statement Service.
9. You understand that SimplyGo will use its best endeavours to ensure the security of the Service. Notwithstanding the foregoing, you agree that SimplyGo shall not liable in any manner for any disruption, unavailability of the Service, communication, electrical or network failure that may result in the e-Statements being incomplete, unavailable or delayed in transmission. You also understand that the while SimplyGo will take all reasonable measures, we cannot guarantee that the use of and the transmission of information via email is secure, and that the information transmitted may be liable to errors, viruses, delay, interception, modification or amendment by unauthorized persons, the transmission may be disrupted, interrupted, delayed or incorrect. You agree that in subscribing to the Service, you will not hold SimplyGo responsible for any errors, viruses, delay, inaccuracy, losses, damages whatsoever arising from or in connection with the customer use of the Service including but not limited to any interception, modification or amendment, disruption, interruption, delay or inaccuracy of e- mails or internet transmission or other communication equipment or facilities. For the avoidance of doubt, SimplyGo shall not be responsible for any losses suffered whether direct, indirect, consequential, or special loss, even if SimplyGo shall have been advised of the same.
10. You agree that you will not hold SimplyGo responsible for any consequences that may arise as a result of any online communication between you and SimplyGo which may be lost in transmission (whether in whole or in part).
11. You acknowledge and agree that SimplyGo shall have the right to amend any term(s) of this agreement at any time by giving such notice in writing to the customer, whether by mail, facsimile, e-mail notification or otherwise or by notices at SimplyGo ’s website, and your continued subscription to the Service will constitute your agreement to the amendment(s).

You agree to be bound by these terms and conditions (and as varied from time to time) in order to enjoy the benefits of the ‘Card Blocking Service’.
General
1 SimplyGo’s ‘Card Blocking Service’ (“CARD BLOCKING SERVICE”) is operated by SimplyGo Pte. Ltd. (“SimplyGo”) and is available to ez-link cardholders in accordance with these terms and conditions.
2 CARD BLOCKING SERVICE is offered by SimplyGo at its sole discretion and is available only to valid ez-link cardholders.
3 “Card” in these Terms refer to both CEPAS ez-link card (“CEPAS Card”) or ez-link card that have been upgraded to Account Based card (“Upgraded Card”),
4 SimplyGo may amend these terms and conditions, as well as vary, suspend or terminate the CARD BLOCKING SERVICE at any time and for any reason, without prior notice to you. We will post any changes to these terms and conditions on the CARD BLOCKING SERVICE web site. You should therefore review the terms and conditions periodically for changes, and your continued use of the CARD BLOCKING SERVICE shall constitute acceptance of any changes to the terms and conditions, or the CARD BLOCKING SERVICE.
5 The CARD BLOCKING SERVICE specific terms and conditions apply to each. You are advised to read them carefully.
Card Blocking for Lost Card
6 You are entitled to enjoy our CARD BLOCKING SERVICE for lost Cards which have been registered under the CARD BLOCKING SERVICE. If your Card is lost or stolen, you may request for your Card to be blocked and any remaining stored value available at the time when your Card is blocked to be refunded to you.
7 In order to enable the CARD BLOCKING SERVICE for your Card, you will need to do the following:
a. Have downloaded the SimplyGo mobile app via Android Play Store or Apple App Store;
b. Created and registered an account on the SimplyGo mobile app;
c. Added the Card that you wish to enable the CARD BLOCKING SERVICE for on your SimplyGo mobile app; and
d. In physical possession of the Card at the point of adding of Card to the SimplyGo mobile app.
8 Do note that the CARD BLOCKING SERVICE is conditional upon you being the owner of the Card and in physical possession of the Card at the point the Card is added to the SimplyGo mobile app. In the event that you have lost the Card or otherwise not in possession of the Card, you are not entitled to add the Card to the SimplyGo mobile app for the CARD BLOCKING SERVICE. In the event that we are of the view that you have added the Card to the SimplyGo mobile app AFTER you have lost the Card or otherwise not in physical possession of the Card, or if there is doubt as to the ownership of the Card, we shall not be obliged to allow you the CARD BLOCKING SERVICE in relation to that Card or to refund you the remaining stored value in the Card. For avoidance of doubt, the possession of the card ID number shall not be proof of ownership of the Card.
9 Upon making the lost report either via the SimplyGo mobile app or the SimplyGo hotline, the Card will be blocked in accordance with the following timelines:
a. Upgraded Cards will be blocked immediately after you have enabled blocking of the card via the mobile app or reported the loss via the SimplyGo hotline;
b. CEPAS Cards that have not been upgraded will be blocked within 48 hours after you have enabled blocking of the Card via the mobile app or reported the loss via the SimplyGo hotline.
10 Before making the loss report, we advise that you should be sure that your Card is in fact lost or otherwise not recoverable. Once the Card is blocked, it will be permanently invalidated and cannot be re-activated or used even if the lost Card is recovered. We only provide a card blocking service and we will not provide you with any replacement card for any lost or stolen Card.
11 For your protection, you will be asked to provide verification of personal information provided during your registration of the CARD BLOCKING SERVICE. We will not accept any loss report if the verification details do not match the personal information previously provided or if we have reasons to believe that the personal information provided is false, inaccurate or incomplete.
12 Where you have enabled the blocking of the lost Card, you will need to nominate a pre-existing Card registered with the CARD BLOCKING SERVICE or to register a new Card with the CARD BLOCKING SERVICE with the SimplyGo mobile app to enable the refund. You will be notified by SMS within 9 days in the case of CEPAS Card or 7 days in the case of Upgraded Card of the blocking of the lost Card that the refunded amount will be available for synchronisation with your nominated card to receive the refund. We will notify you on the status of the Card Blocking within 1 month from the date you nominate or register a replacement card. For Upgraded Cards, you may opt to refund to a nominated FAST participating bank account, where the refund will be transferred into your bank account within 7 days.
13 Upon notification by us, you will need to tap and update/synchronize your nominated Card to complete the transfer of recovered stored value from your lost Card(s) onto your new Card via the SimplyGo Mobile app. You will need to update/synchronize your card to complete the transfer of remaining stored value within 90 days failing which you will be deemed to have abandoned your claim to the remaining stored value, and your claim will expire and have no further right to claim the refund of the remaining stored value. SimplyGo shall have the right to deal with such unclaimed remaining stored value as it deems fit.
14 If you are also a customer of our Auto Top-up by Card or Auto Top-up by GIRO facility, the terms and conditions applicable to the respective facilities will still apply. Please refer to www.simplygo.com.sg on the terms and conditions applicable, including your rights and obligation relating to blocking of lost cards. Please note that for Auto Top-up by Card or Auto Top-up by GIRO customers, any stored value recovered will be refunded instead back to your credit/debit card account or bank account, as the case may be.
15 You are deemed to have abandoned your claim for the loss Card if:
a. You do not provide us any requested information for us to verify your identity against the personal information in our records
b. You do not nominate another Card with the CARD BLOCKING SERVICE to facilitate the transfer of the refund amount
c. You do not update/synchronise your nominated Card via the SimplyGo Mobile app within 90 days
Transaction History
16 Members will be entitled to view the detailed transaction history for registered cards displayed, which are for 90 transactions up to the past 2 months. While we strive to make the information as accurate as possible, this is subject to information updated or accurately provided by merchants and/or public transport operators. We do not warrant the accuracy of any information provided under the CARD BLOCKING SERVICE.
DEFINITIONS AND INTERPRETATIONS
1. In these terms and conditions (“Terms and Conditions”), the following words and expressions shall have the meaning ascribed to them:
“Account” means your credit card account in which you have authorised us to enable us to make deductions in respect of the provision of Motoring Services.
“Account Holder”, “You” or “Your” in relation to any Account means the person to whom the Account belongs to and who is using the Motoring Services.
“Application” means an online or hardcopy application required to be submitted to SimplyGo including via SimplyGo website or SimplyGo mobile app or such other means for purposes of application for Motoring Service.
“Card” means any Visa or Mastercard credit/debit card issued by a Card Issuer, or such other credit/debit card accepted by SimplyGo, which may be used by the Account Holder as a means of payment for Electronic Road Pricing (ERP) and Electronic Parking Services (EPS) only.
“Card Holder” means the person using Motoring Services.
“Card Issuer” means the bank or financial institution which has partnered with SimplyGo to allow Cards issued by it to be accepted for Motoring Services.
“Motoring” or “Motoring Service” means the post-paid card-less payment solution for payment for Electronic Road Pricing (ERP) and Electronic Parking Services (EPS), and paid for by the Account Holder through the debiting of payments from the Account.
“Motoring Account” means an account which has been set-up for you online when you register for the Motoring Services in order to view your transactions.
“SimplyGo”, “We”, “Us” or “Our” means SimplyGo Pte. Ltd. a company incorporated in Singapore providing the Motoring Service.
2. Words importing the singular shall include the plural and vice versa, words importing a gender shall include every gender.
REGISTRATION
3. Before you can use Motoring Service, you must register your vehicle and Card details with SimplyGo in order to open a Motoring Account.
4. To use the Motoring Service:
i. You must be the owner of a privately-owned Singapore registered vehicle which you are registering for;
ii. You must have a credit card issued by Card Issuer and valid for use. This is the registered card for the Motoring Service;
iii. You can register up to three vehicles for one Card in order to obtain a Motoring Account.
iv. You may register any vehicle that is not owned by you to your Motoring Account, but you will be liable for all Motoring charges charged to your Card.
5. You must register with us by filling in an online application at our website or hardcopy application or via the SimplyGo mobile app to register for the Motoring Service. You must provide us with accurate, complete and updated information when registering your personal particulars with us.
6. It will take about five (5) working days to process your application. We will send you an SMS and email notification in an estimated of 4 working days to advise on the application status, your Motoring Account and the effective start date of the Motoring Service.
7. You agree and understand that the Motoring shall only be useable for payment on Electronic Road Pricing (ERP) charges collected by Land Transport Authority and Electronic Parking Services (EPS) services at selected car parks which accept payment via EPS solutions.
8. In consideration of providing this Motoring Service, you hereby agree:
i. that this Terms and Conditions shall bind on you in respect of all matters relating to the use of the Motoring Services;
ii. that we shall be entitled to obtain and hold a pre-authorisation (“Pre-authorisation”) from your available credit limit under your Card and this amount will be held by us for a recurring period of 5 calendar days to be applied towards your Account when it reaches a value of S$50.00 or less. You may see the Pre-authorisation amount reflected in your Card statement. You acknowledge that the Pre-authorisation amount will not be available for your use under the Account until either the Pre-authorisation amount is applied in full or where SimplyGo releases the Pre-authorisation (for any reason including upon unsuccessful Pre-authorisation). You acknowledge that the Pre-authorisation can be held for a period of 5 calendar days (or such other period we require) and the Pre-authorisation can be refreshed by us so long as you are registered for the Motoring Service. You acknowledge that notwithstanding that SimplyGo has released the Pre-authorisation, the amount will only be available for your use after the Card Issuer has effected the release of the amount into the Account, which shall be on a best efforts basis after 7 days;
iii. In the event that SimplyGo is unable to obtain a Pre-authorisation, SimplyGo shall have the right to terminate the Motoring Service without notice;
iv. that SimplyGo shall be entitled to inform the Card Issuer of the Pre-authorisation and that the use of Motoring Service shall be charged to the Card; and that SimplyGo shall be entitled to inform the Card Issuer to charge your Account with any monies that may be due from you to SimplyGo for the use of Motoring Service pursuant to these Terms and Conditions or otherwise;
v. that SimplyGo shall be entitled to inform the Card Issuer to credit the Account with any monies that may be due from SimplyGo to you in respect of refund of monies by SimplyGo to you pursuant to these Terms and Conditions or otherwise; and
vi. that SimplyGo shall be entitled to terminate the Account where the Account Holder is in breach of these Terms and Conditions. This shall include but not limited to SimplyGo terminating the Account.
CONDITIONS OF USE OF MOTORING SERVICE
9. You hereby undertake as follows:
i. to ensure that the Terms and Conditions contained herein are adhered to by you at all times;
ii. to ensure that the Account is valid at all times and there are sufficient funds or sufficient credit limit in the Account at all times in order to meet deductions by SimplyGo pursuant to the Motoring Service and in accordance with these Terms and Conditions;
iii. to inform SimplyGo immediately of any closure or termination of the Account or change in the Account that may prevent SimplyGo from obtaining a Pre-authorisation or effecting charges from the Account;
iv. to provide SimplyGo with any information as may be reasonably requested by SimplyGo in relation to the issue, use and termination of the Motoring Service, and to render any and all necessary assistance to SimplyGo and/or any agents appointed by SimplyGo in relation to any investigation relating to the use of the Motoring Service;
v. to immediately instruct SimplyGo to terminate the Motoring Service prior to the closure or termination of the Account or in the event the Card is lost or stolen; and
vi. to be responsible for all Pre-authorisations and charges made to the Motoring Account notwithstanding the loss or theft of the Card or the theft or transfer of the vehicle to which the Motoring Account is registered to until such time when you inform us to close or terminate the Motoring Account.
PAYMENT
10. In the event that we fail to receive payment for the Motoring Service or for any reason whatsoever, we have the right to do any or all of the following:
i. Recover for the payment from you to be paid to SimplyGo in respect of the services (including legal costs on a full indemnity basis). In addition, we are entitled to recover any outstanding amounts due from you by charging the Card including but not limited to deducting the payment from the Pre-authorisation amount.
ii. For the purpose referred to paragraph 10(i), SimplyGo shall have the right to suspend the use of and/or terminate the use of the Motoring Service.
iii. Terminate the Motoring Service without notice pursuant to paragraph 15.
iv. Disqualify you from applying for, being considered for and/or successfully accepted under the Motoring Service for such length of time as may be determined to be appropriate by us.
v. In terminating the Motoring Service, we shall not be liable to you for any fines or penalties arising from non-payment of ERP or EPS charges arising from the Motoring Service being terminated.
TERMINATION OF MOTORING SERVICE
11. You may terminate Motoring Service through our website. You shall pay all outstanding monies payable to SimplyGo prior to termination of Motoring Service.
12. You will be required to terminate and re-apply Motoring Service should there be a change in the number of the registered Card.
13. You will be required to terminate Motoring Service if the registered vehicle has been sold or if the registered vehicle or the applicable IU is lost or stolen, failing which you will be liable for all charges incurred by that vehicle. You shall remain liable for any Motoring payments arising from your failure or delay in terminating the Motoring Service. You may re-apply for the Motoring Service for the new vehicle.
14. Motoring Service may be terminated by SimplyGo upon giving written notice of the intention to terminate the Account Holder. Up to four (4) working days are required to process the termination.
15. Notwithstanding paragraph 10(iii), SimplyGo reserves the right to immediately terminate Motoring Service upon written notice to the Account Holder and the Card Issuer in the event that:
i. there is a breach by the Account Holder in respect of any of the Terms and Conditions contained herein;
ii. there is a failure to receive payment of monies owing to it as provided in paragraph 10;
iii. the Account of the Account Holder is no longer valid; or
iv. SimplyGo is unable at any time to successfully obtain pre-authorisation from the Account.
16. Where you owe any amount to SimplyGo in respect of Motoring Services provided by SimplyGo, SimplyGo may in its discretion reject any further application to register Motoring Service until all amounts owing has been paid in full.
AMENDMENT
17. SimplyGo may from time to time amend any part of these Terms and Conditions as SimplyGo thinks fit. SimplyGo will send you a notice for the amendments by SMS or email, or by any method which SimplyGo thinks fit. You agree that any notification of amendments as aforesaid shall be sufficient notice for the purpose of this paragraph. The continued use of Motoring Service after the date of such notification shall constitute an affirmative acknowledgement by you of the amendments and shall be deemed to be your acceptance of such revised Terms and Conditions.
NOTICES
18. Unless otherwise provided herein all notices, demands or other communications by SimplyGo shall be in writing to the address of the Account Holder as stated in SimplyGo’s records and shall be deemed served if delivered:
I. by SMS to the mobile number registered with SimplyGo
II. by hand, on the day of delivery;
III. by ordinary post, on the day following that on which the notice was posted; or
IV. by email, on the day the email was transmitted.
NO WAIVER
19. No failure or delay on the part of SimplyGo or its agents in exercising any power right or remedy under the Terms and Conditions shall operate as a waiver of such power right or remedy, nor shall any single or partial exercise of any power right or remedy preclude the further or other exercise thereof, or the exercise of any power right or remedy which it may have.
INDEMNITY
20. You shall indemnify and keep fully indemnified SimplyGo at all times against all liabilities, costs (including legal costs on an indemnity basis), expenses, damages and losses including any direct losses and all interest, penalties and other reasonable costs and expenses suffered or incurred by you arising from any breach arising out of or relating to the use of Motoring Service, as well as any actions or your omissions.
LIMITATION OF LIABILITIES
21. You agree that SimplyGo shall not be liable to you for any loss or damage howsoever caused and regardless of the form of loss or damage which may be suffered or incurred by SimplyGo in connection with this Terms and Conditions including (without prejudice to the generality of the foregoing) any loss of profit, revenue, anticipated savings, indirect or inconsequential damages of any kind whatsoever caused by you.
RIGHT OF THIRD PARTIES
22. A person or entity who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act to enforce any term of these Conditions, regardless of whether such person or entity has been identified by name, as a member of a class or as answering a particular description. For the avoidance of doubt, nothing in this paragraph shall affect the rights of any permitted assignee or transferee of these Terms and Conditions.
PERSONAL DATA
23. In the course of providing the Motoring Services, you understand and agree that SimplyGo may collect, compile, store, process and use Personal Data belonging to you for the purposes of processing, providing and managing the Motoring Services. You also agree that SimplyGo has the right to disclose Personal Data collected from you to Land Transport Authority and SimplyGo’s subcontractors for the purpose of operating and providing the Motoring Services.
24. SimplyGo represents and warrants that it shall comply with the requirements of the Personal Data Protection Act 2012 (“PDPA”) in respect of the collection, use, disclosure and other handling of Personal Data, and that such data will not be transferred out of Singapore for any reason. “Personal Data” means data, whether true or not, about an individual which can be identified
i. from the data; or
ii. from that data and other information to which the receiving party has or is likely to have access.
LAW
25. The Terms and Conditions are governed by and shall be construed in accordance with the laws of Singapore. You hereby submit to the exclusive jurisdiction of the Singapore courts.
