Definitions and Interpretations 

“Bus(es)” refers to bus(es) operated by Go-Ahead Singapore Pte Ltd, SBS Transit Ltd, SMRT Buses Ltd, Tower Transit Singapore Pte Ltd and any other entities contracted by the Land Transport Authority of Singapore.

“Card” refers to any SimplyGo EZ-Link/Concession card, contactless NETS bank card, NETS Prepaid card, Mastercard or Visa credit, debit or prepaid card including Mobile Payment, or any other payment scheme cards approved by the Land Transport Authority, for use as a means of payment for fares on Trains and Buses.

“Cardholder” refers to the person to whom the Card is issued.

“Card Issuer” refers to the bank, financial institution or corporation issuing the Card.

“CEPAS Standard” refers to the Singapore Standard for Contactless e-Purse Application.

“Mobile Payment” refers to the point-of-sale payment made by a mobile device including smart watch with Near Field Communications (NFC) capabilities.

“Registered Card” refers to a Card that has been added to Your SimplyGo account.

“SimplyGo” refers to the acceptance of Cards for fare payments on Trains and Buses, including via Mobile Payment, and the use of a SimplyGo account.

“SimplyGo System” refers to the system which enables commuters to use their Card directly or via Mobile Payment for payment of fares on Buses and Trains.

“SimplyGo account” refers to the account that you register via the SimplyGo Portal or SimplyGo app. Upon successful creation and activation of the account, You can view travel transactions and charges imposed on the Registered Card(s), submit claims if there are any discrepancies in the travel transactions or billings of the linked Card(s), and perform other functions and services available on the app.

“Train(s)” refers to mass rapid transit (“MRT”) and light rail transit (“LRT”).

“You” refers to the person who intends to or has registered for a SimplyGo account and/or uses a Card(s) to pay for fares on Trains and Buses, including Mobile Payment.

These terms and conditions apply to the use of SimplyGo. By registering for a SimplyGo account and/or using a Card(s) to pay for fares on Trains and Buses, You are deemed to have read, acknowledged and agreed to these terms and conditions contained herein and all other future revisions which SimplyGo Pte. Ltd. (“SimplyGo”) may in its discretion update from time to time.

 

Registration and Activation of SimplyGo Account

1.    You may register for a SimplyGo account via the SimplyGo app or SimplyGo Portal by providing Your personal details. A validation of Your mobile number is mandatory for the purpose of registration. SimplyGo reserves all rights to refuse any registration made pursuant to an invalid mobile number.

2.    You will also be required to log in to Your SimplyGo account and update changes to Your personal details within 14 days to ensure that such details are updated in a timely manner.

3.    The SimplyGo account is personal to You and is non-transferable. You must use Your personal password to access Your SimplyGo account. You are responsible for safekeeping and maintaining Your password confidentiality. You shall be responsible for any and all activities initiated from Your SimplyGo account, including any activity by authorised or unauthorised users. You agree to take reasonable measures and all due care to protect the password against misuse by third parties.

4.    You can add up to 10 Cards to Your SimplyGo account to have access to our services, including but not limited to viewing Your journey and payment transaction history for up to 180 days.

5.    You warrant that You are the owner of the Card(s) added by You to Your SimplyGo account, or that You have the expressed consent of the owner to do so.

6.    To add a Card to Your SimplyGo account, You have to fill in the mandatory fields stipulated in the SimplyGo app or SimplyGo Portal.

7.    When adding a Mastercard or Visa credit, debit or prepaid card to the SimplyGo account, You will have to undergo authentication through the payment gateway in the form of a One-Time-Password (“OTP”) sent via SMS to Your mobile number registered with the Issuing Bank. This process will not apply when a contactless NETS bank card, NETS Prepaid card or a SimplyGo EZ-Link/Concession card is added to Your SimplyGo account.

8.   If Your Registered Card(s) is misplaced or lost, You are responsible to promptly contact the relevant Card Issuer to block the relevant Registered Card(s).

 

Using your Card to Pay for Bus and Train Fares

9.    Card(s) can be used to pay for Train and Bus fares without registering for a SimplyGo account. Mastercard or Visa contactless cards added to the mobile wallet can also be used to pay for Train and Bus fares.

10.    Cardholders who wish to use Mastercard or Visa contactless cards with CEPAS (EZ-Link or NETS FlashPay) function (“Co-brand Cards”) will have to switch the payment mode of such Co-brand Cards at any Assisted Service Kiosk or Top-Up Kiosk located at the Train stations and Bus Interchanges.

11.    Card(s) with insufficient credit limit, insufficient funds and/or Card(s) that has been reported as lost or stolen will not be accepted for travel on Trains and Buses.

12.    Some forms of Mobile Payment may not be accepted for fare payment. Please refer to the list of mobile devices and operating system versions which have been tested and accepted for use in the FAQ page. If the Mobile Payment is not accepted, please contact the relevant Mobile Payment provider for assistance.

13.    Upon tapping Your Card or mobile device on the card reader on board a Bus and/or at the Train station fare gate, You are deemed to have given valid authorisation for the trip fare to be charged to the Card.

14.    Distance based adult fares will be charged if using SimplyGo EZ-Link card, contactless NETS bank card, NETS Prepaid card, or Mastercard or Visa credit, debit or prepaid card including Mobile Payment. Concessionary fares will be charged if using SimplyGo Concession card. No additional charge will be imposed when using Singapore-issued Mastercard or Visa credit, debit or prepaid card for fare payment. An administrative fee of $0.60 will be imposed on foreign bank cards per day of use for fare payment. This is to defray the additional cost for processing foreign bank cards.

15.    You must tap the Card on the card reader upon boarding and alighting from a Bus, or when entering and exiting a Train station fare gate. A fare will be charged if the Card or mobile device is tapped on the card reader at the point of boarding or alighting from a Bus or when entering or exiting a Train station fare gate, regardless of whether a trip has been taken.

16.    If the card reader on board the Bus emits a green light with a single/double beep when the Card or mobile device is tapped, it means the Card or Mobile Payment has been accepted for payment. If the card reader emits a red light with two beeps when the Card or mobile device is tapped, it means the Card or Mobile Payment has been rejected.

17.    If the card reader at the Train station fare gate emits a green/yellow light when the Card or mobile device is tapped, this means the Card or Mobile Payment has been accepted for payment. If the card reader emits a red light when the Card or mobile device is tapped, it means the Card or Mobile Payment has been rejected.

18.    If the Card or Mobile Payment is rejected at the point of boarding a Bus or entering a Train station fare gate (due to insufficient fund, insufficient credit limit or otherwise), You shall use an alternate form of payment for the trip or otherwise shall be disallowed to board the Bus or enter the Train fare gate.

19.    If the Card or Mobile Payment is rejected or not tapped on the card reader at the point of alighting from a Bus, You will be charged the full fare from the boarding point to the terminal stop of the bus service.

20.    If a Card or Mobile Payment is rejected at the point of exit from a Train station fare gate, You could approach the Passenger Service Centre for assistance and use an alternate form of payment to exit the Train station fare gate.

21.    You are required to show the Card to the Public Transport Officials during inspection on board Buses and at Train fare gates and shall comply promptly with such requests for inspection. Without limitation to the foregoing, You may be asked to tap the Card on the official’s portable card reader for inspection.

22.    If the Card is not tapped properly on the card reader at the point of boarding a Bus or when entering a Train station fare gate, You may be penalised for fare evasion during inspection by Public Transport Officials.

23.    You may experience card clashes if multiple Cards in Your wallet are collectively tapped on a card reader. Card clashes may result in error messages or incorrect fares being charged. To avoid card clashes, You should ensure that only the same Card or same Mobile Payment mode to be used for payment is held in close proximity to and/or tapped on the card reader when entering and exiting a Train station fare gate, or boarding and alighting a Bus. 

I.    If 2 different Card(s) (which include Mobile Payment modes/devices), were used when boarding and alighting from a Bus, You will be charged the fare from the boarding point to the terminal stop of the bus service on the Card that was tapped upon boarding, as well as the fare from the first stop of the bus service to the alighting point on the other Card that was tapped upon alighting from the Bus.

II.    If 2 different Card(s) (which include Mobile Payment modes/devices), were used when entering and existing the Train station fare gate, You will be charged a flat fare (for SimplyGo EZ-Link card / Adult Monthly Travel Card / Tertiary Student Concession card, contactless NETS bank card, NETS Prepaid card, or Mastercard or Visa credit, debit or prepaid card) or maximum concessionary fare (for other SimplyGo Concession cards) for the Card that was tapped upon entry, and another flat fare or maximum concessionary fare (for the respective card types above) for the Card that was tapped upon exit.

24.    Upon first usage of the Card (for contactless NETS bank card, NETS Prepaid card, and Mastercard or Visa credit, debit or prepaid card) at the point of boarding a Bus or when entering a Train station fare gate, an authorisation request will be sent to the Card Issuer to approve the transaction. Subsequent authorisation requests and transactions will be sent and posted on an aggregated basis.

25.    The amount of funds to be earmarked by the Card Issuer and thereby deducted from the credit/debit limit or account of the Card (for contactless NETS bank card, NETS Prepaid card, and Mastercard or Visa credit, debit or prepaid card) upon receiving the initial authorisation request shall be based on the sole discretion of the Card Issuer.

26.    There shall be no cap on the amount of fares or the number of commutes You can use a Card for, subject to the credit/debit limit or funds available in such Card.

27.    Transactions (for contactless NETS bank card, and Mastercard or Visa credit, debit or prepaid card) will be processed and reflected in Your credit/debit card bills or bank statements, where applicable. The amount displayed in Your bill or bank statement will be an aggregated amount for the relevant travel period.

28.    If there is any discrepancy in the transactions recorded in Your SimplyGo account, You may submit a claim for fares overcharged via the SimplyGo app or SimplyGo Portal.

 

General

29.    You shall be responsible for obtaining and using the necessary software and/or device to obtain access to Your SimplyGo account and shall be responsible to Your mobile service provider for all data charges relating to the download/upgrades of SimplyGo app and use of SimplyGo.

30.    SimplyGo Pte. Ltd. reserves the right to determine that a Cardholder is not eligible to use the services of SimplyGo or to use a Card to pay for fares when travelling on the public transport system for any reason, including, but not limited to, errors or missing information in such Cardholder’s SimplyGo account, suspected fraud, or a breach of these conditions.

31.    SimplyGo Pte. Ltd. reserves the right to suspend or terminate Your SimplyGo account at any time, for any reason, and without liability to You.

32.    The access to and use of SimplyGo app is offered to You on an “as available, where available” basis. SimplyGo does not guarantee or represent any expressed or implied warranty that the app is available at all times and/or is compatible with all mobile platforms and/or software versions. The features and functionalities shall be on an “as is” basis and SimplyGo neither guarantees nor represents any expressed or implied warranty that it is free from any bugs or code errors.

33.    SimplyGo may in its sole discretion, change, add or remove any feature or functionality of SimplyGo app at any time without any prior notice.

34.    SimplyGo shall not be liable for telephone, electronic, hardware, software programme, network, internet, or computer malfunctions, interruptions, failures, delays, difficulties, theft, destruction, unauthorised access or errors in transmission of any information in connection with SimplyGo, SimplyGo app or SimplyGo Portal.

35.    By registering a SimplyGo account, You consent to SimplyGo collecting, using, disclosing and storing Your personal data as provided through registration for the purposes of administering Your account, processing the transaction details of Your Registered Card(s) for display and use, contacting You to provide any customer service (including but not limited to sending You via email and push notification, information related to the use of SimplyGo, SimplyGo app or SimplyGo Portal, updates on services or important information relating to Your SimplyGo account and Your Registered Cards) and any other purposes arising out of Your usage of the SimplyGo app. Subject to Your consent, You agree that we may collect, use and disclose Your personal data to send You promotion and campaign details to promote and encourage the use of SimplyGo. If You wish to withdraw Your consent, You agree and understand that it will result in Your inability to continue using the SimplyGo app.

36.    All personal information collected by SimplyGo is subject to the Data Privacy Policy at www.simplygo.com.sg/data-privacy-policy (“Privacy Policy”).

37.    These terms and conditions shall be construed, governed by and enforced under the laws of Singapore.

The use of a Concession Card as a contactless stored value facility and as a Ticket and for payment of fares for travel in the Public Transport System and/or Qualified Goods and/or Services shall be subject to these Conditions and all applicable laws and regulations. By using a Concession Card as a Ticket and for payment of fares for travel in the Public Transport System, the Concession Card Holder agrees to be and shall be bound by these Conditions. 

 

1. Definitions 

In these Conditions, the following words and expressions shall, unless otherwise provided or the context otherwise requires, have the following meaning:  

Act means the Public Transport Council Act 1987 as amended from time to time.
Authorised Person means such person authorised in writing by  the Land Transport Authority of Singapore (LTA) to carry out such function as referred to in these Conditions.
Card means any stored value facility whether in the form of a card or otherwise.
Card Cost means the cost of the Concession Card payable by a Concession Card Holder for the issuance of a Concession Card in such amount as may from time to time be determined by the Issuer.
Concession Card

means a Card which is issued by LTA and/or otherwise accepted for use by 

(a) any Operator as a Ticket and for the payment of concessionary fares for travel on designated routes using the Public Transport System, and includes by reference:  

  • Child Concession Card (“Child Card”)  
  • Primary (MOE) Student Concession Card (“Primary (MOE) Card”);  
  • Primary (Non-MOE) Student Concession Card (“Primary (Non-MOE) Card”);  
  • Secondary/Pre-U (MOE) Student Concession Card (“Secondary/Pre-U (MOE) Card”);  
  • Secondary/Pre-U (Non-MOE) Student Concession Card (“Secondary/Pre-U (Non-MOE) Card”);  
  • Diploma Student Concession Card (“Diploma Student Card”);  
  • Undergraduate Concession Card (“Undergraduate Card”);  
  • Cards issued by Private Education Institutions (PEIs) registered with the Committee for Private Education (“PEI Student Card”);  
  • National Service Full-time Concession Card (“NSF Card”);  
  • Senior Citizen Concession Card (“Senior Citizen Card”);  
  • Adult Monthly Travel Card (“AMTC”);  
  • Workfare Transport Concession Card (“WTC Card”); and  
  • Persons with Disabilities Card (“PWD Card”)  

(b) any Qualified Merchants for payment of Qualified Goods and/or Services.  

Concession Card Holder means the holder of a Concession Card to whom the concession privilege is granted and whose name and NRIC/FIN or Birth Certificate number is printed on the Concession Card or recorded electronically in the Concession Card.
Concession Card System means the computerised system operated and managed by SimplyGo Pte. Ltd. (SPL) or Qualified Merchants designated by LTA for Concession Card transactions and provision of Qualified Goods and/or Services.
Fares means the amount payable to the Operators for Transit Services.
TSK means a Ticketing Service Machine providing transit ticketing services at MRT stations or Bus Interchanges and includes Top-Up Kiosk (TUK) and Assisted Service Kiosk (ASK).
SimplyGo Kiosk means a SimplyGo Kiosk.
Issuer means the issuer of the Concession Card.
LTA means the Land Transport Authority of Singapore, a statutory body formed under the Land Transport Authority of Singapore Act 1995.
Operators means any licensee of any licence granted pursuant to section 12 of the Act or section 13 of the Rapid Transit Systems Act 1995.
Passes means an electronic product offered by SPL or Qualified Merchants designated by the relevant authorities in Singapore, that can be encoded onto specific concession card to confer concessionary travel at a fixed pricing on specific Public Transport System modes.
PSC means Passenger Service Centre.
PTC means the Public Transport Council of Singapore, as established under the Public Transport Council Act 1987.
Public Transport System means the public bus and rail systems from time to time operated by the Operators.
Qualified Goods and/or Services means the goods sold and/or the services rendered by Qualified Merchants.
Qualified Merchants means persons approved by LTA and/or Authorised Persons to be engaged in the sale of the Qualified Goods and/or the provision of Qualified Services. A Qualified Merchant is authorised by LTA to accept debits on the Stored Value of Concession Cards as a means of payment for such Qualified Goods and/or Services and provide services which involve the reading/writing of electronically encoded data on Concession Cards.
Rail means the Mass Rapid Transit and Light Rapid Transit Systems.
Revaluation means the process whereby the Stored Value of a Card is increased by such means as prescribed by the Issuer and agreed by the holders of such Cards and the word “revalue” as used in these Conditions shall bear the same meaning.
Stored Value or stored value means the initial monetary value paid for and stored in a Concession Card, including by means of a Revaluation, or the residual value remaining therein from time to time (excluding the Card Cost as defined hereinafter), which may be used by a Concession Card Holder for the payment of Transit Services and/or Qualified Goods and/or Services.
Ticket means a Concession Card which is issued as a form of authorisation for the conveyance of any passenger on the Public Transport System, as understood within the context and meaning of the Act.
TSC means SimplyGo Ticketing Service Centres.
SPL means SimplyGo Pte. Ltd., its successors and assigns.
TO means SimplyGo Ticket Office.
Transit Services means the services from time to time provided by the Operators for or in connection with the transportation of passengers on the Public Transport System.

The following provisions shall apply to Concession Card Holders: 

  

2. Issue and validity of Concession Cards 

2.1   Concession Cards shall be issued only to eligible applicants. Details on concession schemes, concession travel rates, Passes, concession travel eligibility and conditions relating to concession schemes offered by the Operators / LTA are stipulated at www.simplygo.com.sg. 

2.2   A Concession Card is not transferable and can only be used by the holder of that Concession Card. 

2.3   The validity period of any particular type of Concession Card shall be as stated at www.simplygo.com.sg. The extension of any such validity period is at the absolute discretion of the respective Operators or LTA. In the case of any Child Card, Primary (MOE) / (Non-MOE) Card, Secondary / Pre-U (MOE) / (Non-MOE) Card, Diploma Student Card and/or Undergraduate Card, the extension shall be subject to the provision of all relevant information by the school or institution concerned. Save as aforesaid, Concession Card Holders may seek the extension of their concession status at any TO, TSC, SimplyGo Kiosk, ASK, or PSC/PSO. 

2.4   The use of a Concession Card as a means for fare payment in the Public Transport System shall be subject always to these Conditions and such of the terms and conditions as may from time to time be issued by LTA or such other organisation as may be designated by LTA from time to time to govern the use of any contactless payment medium in the Public Transport System, which terms and conditions shall prevail over these Conditions in the event of any conflict or inconsistency. 

2.5   A replacement Concession Card may be issued, subject to such conditions and to the payment of such sums as LTA may impose. 

  

3. Revaluation of Concession Cards 

3.1   Concession Card Holders may revalue the Stored Value of their Concession Cards from time to time at any TO, TSC, and PSC/PSO via cash, NETS (or such other accepted payment modes), up to the maximum amount of $500 or other amount as may be prescribed for such Concession Card. 

  

4. Card Cost 

4.1   LTA and/or any Authorised Person may collect from the Concession Card Holder an amount to cover the cost of the card ("Card Cost") when the Concession Card is first issued. The Card Cost, which is up to a maximum of $5.00, is non-refundable. 

  

5. Rejection of Concession Cards 

5.1   Notwithstanding any other clause, LTA, any Authorised Person, Operator and/or Qualified Merchant shall be entitled to reject the use of a Concession Card – 

5.1.1   as a Ticket and as a means for claiming concessionary travel in the Public Transport System if: 

  1. it is used by any person who is not eligible or who has ceased to be eligible for concessionary travel; 
  2. it is used by any person who is not the Concession Card Holder of that Concession Card; 
  3. it has expired; 
  4. the Stored Value is insufficient or has been exhausted; 
  5. it is suspected by LTA, SPL, any Authorised Person and/or the Operators:
    1. to be a counterfeit; 
    2. to have been fraudulently or illegally issued or revalued;
    3. to have been stolen or tampered with in any way; or
    4. to have been used in a manner which illegally or fraudulently hinders or prevents the proper deduction of Fares or to evade any Fare payment;
  6. it is damaged, unreadable, defective, faulty or otherwise poses a risk of damage to the Concession Card System;
  7. it has been blacklisted for any reason whatsoever; 
  8. it has not been activated for use in the Public Transport System;
  9. it is not capable or has ceased to be capable of functioning as a Ticket for any reason whatsoever;
  10. the Concession Card System is unable to process the payment for any reason whatsoever or if a force majeure event (see Clause 15) arises which disables and/or prevents the Operators from accepting and/or processing the Concession Card as a means of payment; and/or 

5.1.2   for payment of Qualified Goods and/or Services if: 

  1. the Concession Card has expired; or 
  2. the Concession Card is suspected to have been fraudulently issued, stolen or tampered with or may in any way pose a risk to the Concession Card System; or 
  3. the Concession Card System is unable to process the payment for any reason whatsoever or if a force majeure event (see Clause 15) arises which disables and/or prevents the Qualified Merchants from accepting and/or processing the Concession Card as a means of payment. 

5.2   The Concession Card Holder agrees that each of the Operators and/or Qualified Merchants is responsible for deducting payment for Transit Services and/or Qualified Goods and/or Services, as the case may be, that the Concession Card Holder has agreed with the Operator and/or Qualified Merchant or is agreeable (with the Operator and/or Qualified Merchant) to pay from the Stored Value, in such manner as may be required by such Operator and/or Qualified Merchant. 

5.3    The Operators and Qualified Merchants accepting the use of Concession Cards may be changed from time to time without prior notice. 

  

6. Retention of Concession Cards 

6.1    Notwithstanding any other clause, LTA, SPL, any Authorised Person and/or any of the Operators shall be entitled to seize and retain the Concession Card if: 

  1. it is used by a Concession Card Holder who is not eligible or who has ceased to be eligible for concessionary travel; 
  2. it is used by a Concession Card Holder who is not the Concession Card Holder of that Concession Card; 
  3. it has expired; 
  4. it is suspected by LTA, SPL, any Authorised Person and/or the Operators:
    1. to be a counterfeit;
    2. to have been fraudulently or illegally issued or revalued;
    3. to have been stolen or tampered with in any way; or
    4. to have been used in a manner which illegally or fraudulently hinders or prevents the proper deduction of Fares or to evade any Fare payment
  5. it is damaged, unreadable, defective, faulty or otherwise poses a risk of damage to the Concession Card System;
  6. it has been blacklisted for any reason whatsoever;
  7. it is not capable or has ceased to be capable of functioning as a Ticket for any reason whatsoever. 

6.2   During the period that a Concession Card is retained, the Concession Card Holder shall not be entitled to concessionary travel. In such instance, the Concession Card Holder may purchase an adult anonymous Card or use another appropriate form of Fare payment for travel in the Public Transport System. The Concession Card Holder may, however, make a claim in relation to any retained Concession Card in accordance with Clause 10. 

  

7. Loss or Theft of Concession Card 

7.1   Concession Card Holders are responsible for safeguarding their Concession Cards from loss and theft. LTA, SPL, Operators and Qualified Merchants shall not be responsible to any Concession Card Holder for any losses which may be incurred by a Concession Card Holder as a result of a lost or stolen Concession Card. 

7.2   Concession Card Holders who lose their Concession Card must immediately report the loss of their Concession Card to SPL through the SimplyGo Hotline for the purposes of invalidation. Once invalidation requests are reported by the Concession Card Holders, these are final and irreversible. The lost card may take up to 48 hours to be invalidated from the time of the request. 

  

8. Corrupted Concession Card 

8.1   Concession Card Holders with corrupted, defective or faulty Concession Cards shall present such corrupted Concession Cards to any TSC immediately after such corruption, defect or fault has arisen. 

  

9. Misuse of Concession Cards 

9.1   A Concession Card may only be used by the respective Concession Card Holder who is eligible for concessionary travel of the type associated with the Concession Card and as stipulated at www.simplygo.com.sg. Concession Card Holders are responsible for safeguarding their Concession Cards from misuse. 

  

10. Refunds 

10.1   A Concession Card Holder may claim a refund of any Stored Value rightfully due to the Concession Card Holder. Card Holders who are holding an expired Concession Card may also claim a refund of the remaining Stored Value. 

10.2   Refunds shall be made by LTA, any Authorised Person or SPL, subject to the following conditions: 

  1. The Concession Card in respect of which the claim is made, must be presented unless otherwise determined by LTA, any Authorised Person or SPL. 
  2. The Concession Card must not have been altered, tampered, intentionally damaged, or interfered with. 
  3. A refund shall be made only after LTA, any Authorised Person or SPL is satisfied, after due investigation that the claim is valid. 
  4. The encoded data in the Concession Card and/or its external card number is readable for any reason as determined by LTA, any Authorised Person or SPL. 
  5. Refunds shall be made to the Concession Card Holder or its proxy. 
  6. All refunds shall be made free of interest. 
  7. Unless already retained, the Concession Card shall be surrendered to LTA, any Authorised person or SPL at the time of refund.10.3   A Concession Card Holder may only obtain a refund of the Stored Value at any TO or TSC within four years after the expiry of that Concession Card. 

10.4   Deferred refund of the Stored Value filed by the Concession Card Holder must be collected within 60 days from the collection date. The Concession Card Holder may refer to the collection period printed on the claim receipt once the deferred refund is successfully filed or otherwise advised by SPL personnel. 

  

11. Exclusion/Limitation of Liability 

11.1   Neither LTA, SPL, any Authorised Person, any Operator nor Qualified Merchant (or any of their respective officers, employees or agents) shall be liable for any losses, damages, expenses, claims, liability and costs (including cost on a solicitor and client basis) that a Concession Card Holder may incur or suffer in connection with: 

  1. the use of any Concession Card as a Ticket and/or as a means of Fare Payment in the Public Transport System; 
  2. any delay in the issuance of any Concession Card or in the case of any retained Concession Card, the return of such Concession Card; 
  3. the retention, suspension, discontinuance or revocation of any Concession Card; 
  4. any breakdown or fault in the Concession Card System; and/or 
  5. any damaged, corrupted, defective, faulty Concession Card. 

11.2   Without prejudice to Clause 12.1 above, should any liability be attributed to LTA, SPL, any Authorised Person and/or any Operator in connection with the use of any Concession Card as a Ticket and/or as a means of Fare payment in the Public Transport System and/or as a means of payment for any Qualified Goods and/or Services whatsoever, including but not limited to any event or incident arising from any negligence, the total liability of LTA, SPL, such Authorised Person and/or such Operator to the Concession Card Holder under these Conditions and at law shall not exceed in aggregate the sum of $500. 

11.3   It is expressly acknowledged by the Concession Card Holder that neither LTA, SPL nor any Authorised Person is involved in the provision of the Transit Services and/or the Qualified Goods and/or Services offered by any Operator and Qualified Merchant respectively accepting the Concession Card for payment.  Neither LTA, SPL nor any Authorised Person shall be liable in any way for the Transit Services and/or Qualified Goods and/or Services sold, rendered or provided by the Operators and/or Qualified Merchants (including without limitation any defect, disruption, failure or unavailability of or relating to any of such Transit Services and/or Qualified Goods and/or Services, as the case may be) or for any other disputes concerning the Transit Services and/or Qualified Goods and/or Services, all of which shall be the sole responsibility of the Operators and/or Qualified Merchants, as the case may be. 

  

12. Amendment 

12.1   LTA may from time to time amend, modify or vary any part of these Conditions without any prior notice to Concession Card Holders, save that notice of any such amendments made shall be posted at any TO/TSC at MRT stations and bus interchanges and/or such other premises (including SPL and/or LTA’s website) as may be determined by LTA. The Concession Card Holder’s continued use of the Concession Card after the date of such notification shall constitute an affirmative acknowledgement by the Concession Card Holder of the amendments and shall be deemed to be the Concession Card Holder's acceptance of the revised Conditions. 

  

13. No Waiver 

13.1   No failure or delay on the part of LTA in exercising any power, right, or remedy under these Conditions shall operate as a waiver of such power, right, or remedy. Nor shall any single or partial exercise of any power, right, or remedy preclude the further or other exercise thereof, or the exercise of any power, right, or remedy that it may have. 

  

14. Right of Third Parties 

14.1   Any person or entity which is identified or referred to in these Conditions (whether as a class of persons or otherwise) shall be deemed to be a party to these Conditions and shall accordingly be entitled to the benefit of, and to enforce in its own right, any provision of these Conditions which may be relevant to it or them to the fullest extent permitted by law. Save as aforesaid, the Contracts (Rights of Third Parties) Act 2001 shall not apply to give any person or entity who is not a party to these Conditions any right to enforce any term of these Conditions. For the avoidance of doubt, nothing in this Clause shall affect the rights of any permitted assignee or transferee of these Conditions. 

  

15. Force Majeure 

15.1   Neither LTA, SPL, any Authorised Person, nor any of the Operators or Qualified Merchants shall be liable for any non-performance, error, interruption or delay in the performance of its or their obligations under these Conditions if the same is due, in whole or in part, directly or indirectly to an event or failure which is beyond its or their reasonable control including, without limitation: 

  1. flood, lightning, acts of God, exceptional weather conditions, floods, droughts, storms, high winds, typhoons, fire, earthquakes and other natural disasters; 
  2. impacts with or by air crafts or aerial objects, terrorism (whether actual or threatened), explosions, wars, warlike operations, hostilities, insurgencies, invasions, epidemics, quarantines, acts of foreign or public enemies, hi-jacking or unlawful seizure or wrongful exercise of control of vehicles, curtailment of transportation facilities, civil commotion, riots, strikes or lock-outs on a city or industrial scale, industrial disputes, industrial actions by workmen, shortage of labour, goods and materials; 
  3. judgements, legislation, acts, orders, directives, policies, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any court, governmental, parliamentary and/or regulatory authority imposed or to be imposed after the fact; 
  4. power & telecommunication network failures; 
  5. circumstances where communications lines and/or computer systems cannot be used for reasons attributable to any telecommunications carriers; and 
  6. acts or omissions of any third party. 

  

16. Indemnity 

16.1   The Concession Card Holder hereby undertakes to indemnify and keep LTA, any Authorised Person, SPL, each of the Operators and Qualified Merchants harmless from and against any and all actions, proceedings, claims, liabilities (including statutory liability), penalties, demands, costs (including without limitation, legal costs on a solicitor and own client basis), awards, damages, losses and/or expenses however arising as may be directly or indirectly suffered or incurred by LTA, any Authorised Person, SPL, the Operators and/or Qualified Merchants by reason of and/or as a result of any breach or non-compliance by the Concession Card Holder of these Conditions. 

  

17. Governing Law 

17.1   The construction, validity and performance of these Conditions shall be governed by and construed in accordance with the laws of Singapore. 

 

18. Transit Usage Conditions 

The use of the Concession Card shall be subject to the Transit Usage Conditions available at www.simplygo.com.sg

 

Definitions and General Terms

1.    “SimplyGo App” means an app for mobile devices that can be downloaded by a user (individually a “User” and collectively, “Users”).

2.    “EZ-Link Service” means any service offered by SimplyGo which may be obtained through and from the use of the SimplyGo App, as may be determined by SimplyGo from time to time.

3.    “SimplyGo Pte. Ltd.”, “SimplyGo”, “our”, “we” and “us” means SimplyGo Pte Ltd and its successors and assigns.

4.    “You” means a User.

5.    These Terms of Use herein apply to the use of the SimplyGo App by you. By your use of the EZ-Link Services contained within the SimplyGo App, you are deemed to have read, acknowledged and agreed to these Terms contained herein and all other future revisions, which may be updated from time to time by SimplyGo Pte Ltd.

6.    You agree that you are responsible for keeping up to date with any revisions to the Terms of Use, which shall be binding on you upon the update of the SimplyGo App. If at any time, you do not agree with these Terms of Use and/or wish to discontinue your Services, please kindly cease usage of the SimplyGo App.

7.    You are also responsible for any and all activity from the SimplyGo App initiated from your user account and/or login, including any activity by authorized or unauthorized users. You shall not allow others to use your account credentials and maintain security to your user account at all times. If you should at any time become aware of any breach in the security of your user account or have any reason to believe that your credentials have been compromised, please change your password immediately and notify us of such breach.

8.    These terms of use governing the use of the SimplyGo App and the EZ-Link Service (“Terms”) incorporate any other terms and conditions which may be expressly stated in these Terms. If there is any conflict or inconsistency between these Terms and other terms and conditions, these Terms will prevail.

 

Eligibility for the SimplyGo App

1.    You acknowledge and agree that as a condition for you to access and use the SimplyGo App to effect or obtain the EZ-Link Service, you are required to satisfy all these Terms including any amendments to these Terms that SimplyGo may in its discretion from time to time make.

 

Registration

1.    You are required to create and register for an account in your SimplyGo App (“Registration”).

2.    A validation of your mobile and email is also mandatory for purposes of registration. This will be done via a one-time password sent to your nominated mobile number and email address. We reserve all rights to refuse any registration made pursuant to an invalid or inaccurate mobile number or email address.

3.    You will also be required to provide such personal details as may be required from time to time and to ensure that such details are updated in a timely manner. We shall, if required and to the extent permissible by law, provide the purposes of such collection and/or disclosure.

4.    You must use your personal password (“Password”) to access and use the SimplyGo App. You are responsible for safekeeping and maintaining the confidentiality of your Password. You must not disclose to any person your Password and shall not authorize any person to use your Password for any purpose whatsoever. You agree to take reasonable measures and all due care to protect your Password against misuse by third parties.

5.    You should, as soon as possible, reset your Password should you notice that your SimplyGo App has been accessed or used without your knowledge, authority or consent.

 

Acknowledgement and Agreement

You acknowledge and agree that:

1.    you will be responsible for obtaining and using the necessary software and/or device, hardware and/or equipment necessary to obtain access to the SimplyGo App at your own risk and expense;

2.    you will be responsible to your mobile service provider for all data charges relating to:
(a) the download of the SimplyGo App;
(b) any upgrades you request in relation to the SimplyGo App; and
(c) your ongoing access to and use of the SimplyGo App;

3.    you will not use the SimplyGo App to conduct electronic spamming, upload content that contains viruses or malicious codes, perform unlawful activities, or engage in any other inappropriate activities deemed by SimplyGo;

4.    the access to and use of the SimplyGo App is offered to you on an “as available, where available” basis;

5.    you are solely responsible and liable for any access to and use of the SimplyGo App effected through the use of your Password, notwithstanding that your Password may have been used by any other person without your knowledge, authority or consent;

6.    you shall monitor the balance of your ez-link Card at all times and notify us (in writing, by calling our SimplyGo hotline available at our SimplyGo website at http://www.simplygo.com.sg [“Website”]) immediately of any unauthorized transfers or of any matter concerning your ez-link Card that may invite suspicion;

7.    SimplyGo is entitled to send you “push notifications” and SMS notifications (“Notification”) relating to your access to and use of the SimplyGo App and any updates on related services;

8.    SimplyGo is deemed to have sent the Notification to you, even if you are unable to or do not receive the Notification for whatever reason;

9.    the SimplyGo App may include links to sites on the Internet that are owned and operated by third parties (“Third Party Sites”), and if you choose to access these Third Party Sites, you agree to review and accept the terms of use. SimplyGo has no control over and excludes all liability for and does not assume any responsibility for material created or published by such Third Party Sites;

10.    SimplyGo reserves the right to investigate complaints regarding the use of the SimplyGo App, the EZ-Link Service or reported violations of these Terms and to take any action SimplyGo deems appropriate, including but not limited to reporting any suspected unlawful activity to law enforcement officials, the appropriate authorities or regulators and disclosing any information necessary or appropriate to such officials, authorities or regulators, without any further notification to you;

11.    SimplyGo may, in its sole discretion, change, add or remove any feature or functionality of the SimplyGo App at any time without any prior notice. Your continued use of the SimplyGo App or EZ-Link Services shall be deemed to be your conclusive acceptance of such changes;

12.    SimplyGo may impose, change and/or amend at any time the fees payable for your access to and use of the SimplyGo App and the EZ-Link Service as well as the termination of the EZ-Link Service. Such changes shall be deemed effective upon SimplyGo posting these changes on the Website and your continued access to and use of the SimplyGo App and EZ-Link Services shall be deemed to be your conclusive acceptance of such changes; and

13.    SimplyGo may without giving any reason vary these Terms at any time. Where possible, we will strive to provide you with prior notice of our amendment of these Terms. Where we have not given prior notice, we shall as soon as practicable give notice of such amendments, deletions and additions to you by such notification method as we may choose, including through our other mobile applications, in local newspapers, in displays at any of our touchpoints or via publication through any media. Such amendments, deletions and additions shall be effective on and from the date specified in the notice.

 

Limits of Responsibility and Liability

1.    Any Services or features provided on the SimplyGo App shall be on an “as is” basis and SimplyGo neither guarantees nor represents any express or implied warranty or condition that the SimplyGo App is available for use at all times or free from any bugs or code errors, nor does SimplyGo warrant that the SimplyGo App is compatible with all mobile platforms and/or software versions. You shall use the EZ-Link Services at your own risk and SimplyGo shall not be responsible for any claims, damages, losses or delays arising from the use of the SimplyGo App.

2.    SimplyGo is not liable for any loss suffered by you or any third party arising from and in connection with your Registration of, access to and use of the SimplyGo App and the EZ-Link Service. Without prejudice to the foregoing, SimplyGo will not be liable for any inconvenience, loss, cost, damage or injury suffered by you or any third party arising from or caused by:

1.    our compliance with any instruction given or purported to be given by you relating to a Transaction, notwithstanding that the integrity of the information comprised in such instruction may have been compromised or impaired during transmission, provided that such compromise or impairment would not have been apparent to a reasonable person receiving such instruction;

2.    use of your ez-link Card and the SimplyGo App by third parties, whether authorized or unauthorized by you;

3.    theft or loss of your device, hardware and/or equipment on which the SimplyGo App is installed;

4.    your inability to effect or complete any Transaction due to system maintenance or breakdown/non-availability of the SimplyGo App or any network;

5.    you being deprived of the use of the SimplyGo App and/or the EZ-Link Service as a consequence of any action by us;

6.    any failure by us to perform any obligation or observe any of these Terms if such failure arises from a failure of, or any unauthorised and/or unlawful access to, any machine, data processing system or transmission link or any act of force majeure such as acts of God, war or warlike hostilities, civil commotions, riots, blockades, embargoes, sabotage, strikes, lock-outs, fire, flood, shortage of material or labour, delay in deliveries from sub-contractors, or any event outside our control;

7.    any equipment or software providers, any service providers, any network providers (including but not limited to telecommunications providers, internet browser providers and internet access providers), or any agent or subcontractor of any of the foregoing; or

8.    any act or omission by SimplyGo in compliance with any applicable laws and/or regulations, including laws governing personal data protection, and any instructions and/or directions given by any local or foreign regulatory body, government agency, statutory board, ministry, departments or other government bodies and/or its officials.

3.    Any downloading of data from the SimplyGo App is done solely at your risk, and we will not be liable for the integrity or use of any data downloaded in any way.

4.    SimplyGo shall not, unless otherwise expressly provided for in these Terms of Use, be responsible in any way for any direct, indirect, special or consequential, economic or other damages arising in any way from your entering into any Transaction, using the SimplyGo App or using the EZ-Link Service.

 

Intellectual Property

1.    You acknowledge that the intellectual property rights in or to the SimplyGo App are owned by SimplyGo.

2.    No part or parts of the SimplyGo App may be reproduced, distributed, republished, displayed, broadcast, hyperlinked, transmitted, adapted, modified to create derivative works or otherwise commercially exploited in any manner or by any means or stored in an information retrieval system without our prior written permission.

3.    We shall grant you a limited and non-exclusive license to use the SimplyGo App and its services for your personal use only.

4.    Unless otherwise stated, all logos, marks, material (inclusive of software code) and features of the SimplyGo brand are proprietary to SimplyGo. You shall not copy, redistribute, reverse-engineer or commercially profit from the use of SimplyGo Pte. Ltd.’s intellectual property. You shall also not knowingly exploit this license for illegal, malicious purposes or in any way that is detrimental to the reputation of SimplyGo.

5.    Nothing in the SimplyGo App should be construed as granting, by implication, estoppel, or otherwise, any licence or right to use any Trade Marks displayed in or through the SimplyGo App, without our written permission.

 

Personal Data Protection

1.    Notwithstanding any other consent that you have already provided through the Services, you consent to SimplyGo Pte. Ltd. collecting, using, disclosing and storing your personal information as provided through registration, re-submission or linking of existing details on the SimplyGo App for the purposes of i) managing and creating your account on the SimplyGo App, ii) processing your balance information for display and use, iii) creation of your rewards account on the SimplyGo App, iv) contacting you to provide any customer service or after-sales support, v) providing the EZ-Link Services to you and vi) any other purposes reasonably contemplated arising out of your usage of the SimplyGo App.

2.    The use the SimplyGo App and EZ-Link Services is contingent upon the personal data provided to SimplyGo. If you wish to withdraw your consent or require SimplyGo to remove your personal data, you agree and understand that it may result in your inability to continue using the SimplyGo App or EZ-Link Services.

3.    SimplyGo shall collect, use, disclose and store personal data in accordance with the Personal Data Protection Act (2012) of Singapore. For more information, please refer to SimplyGo’s privacy policy at: https://www.simplygo.com.sg/

4.    The SimplyGo Privacy Policy, as may be amended, supplemented and/or substituted from time to time, is incorporated by reference into and forms part of these Terms and shall apply to all personal data that you provide to us or that arises from your relationship with us.

 

Third Parties

In the course of use of the SimplyGo App, you may encounter promotions or collaborations with other third parties featured in the SimplyGo App, including but not limited to the SimplyGo App’s reward platforms. We do not make any warranties, representations or guarantees regarding the terms and conditions of any contract or agreement entered between yourself and these third parties. Unless otherwise indicated, any and all recourse to these contracts or agreements are strictly confined to the third party.

 

Assignment

SimplyGo may assign any of its obligations in the Terms of Use to any other party. You acknowledge and agree that you shall not assign any of your obligations under these Terms of Use.

 

Termination

1.    We may (at our sole discretion) and without giving any reason suspend or terminate the EZ-Link Service or your use of the SimplyGo App at any time. Such termination shall be effective on and from the date specified in any notice provided to you.

2.    You shall not be entitled to any payment, compensation or damages from SimplyGo in relation to the termination of your access to and use of the SimplyGo App and/or the EZ-Link Service.

3.    SimplyGo’s right to suspend or terminate your access to and use of the SimplyGo App and the EZ-Link Service shall be without prejudice to any other rights or remedies which SimplyGo may have under these Terms and at law.

 

General

1.    These Terms shall be governed by and construed in accordance with the laws of Singapore and you irrevocably submit to the non-exclusive jurisdiction of the Singapore courts.

2.    A person who is not party to any agreement governed by these Terms shall have no right under the Contracts (Rights of Third Parties) Act to enforce any of these Terms.

 

ADDITIONAL TERMS AND CONDITIONS GOVERNING THE USE OF EZ-LINK SERVICE BY SIMPLYGO USER

Registration

During the Registration, your SimplyGo App login credentials will be used as part of the validation checks.

Use of the SimplyGo App
1.    EZ-Link Card Services

1.    You may link up to 7 ez-link Cards (“Register ez-link Cards”) to have access to our services, including but not limited to:

1.    Checking the balance and viewing the transaction history of your ez-link Cards (“Balance Check”)
2.    Performing SimplyGo Top-up (Where possible)  (“ez-link Top-Ups”)
3.    Registration and activation for Auto Top-up (“Auto Top-up”)
4.    Earn and redeem EZ-Link Reward points (“EZ-Link Rewards”)

2.    You warrant that you are the owner of any ez-link Cards linked by you to the SimplyGo App, or that you have the expressed consent of the owner to do so.

3.    Balance Check

1.    All entries in the transaction history listed in your SimplyGo App (“Transaction History”) are based on best available information and SimplyGo makes no warranty as to the accuracy or availability of the transaction history.

4.    EZ-Link Top-Ups

1.    Upon registration, you may save and select at least one Credit Card as your default source of funds. Your Credit Card will be linked to your  ez-link Card to allow the movement of funds between your Credit Card and your ez-link Card. You warrant that the Credit Card belongs to you.
2.    Alternative sources of funds may also be available through third party partnerships (e.g. DBS PayLah!). We do not make any warranties, representations or guarantees regarding the terms and conditions of any contract or agreement entered between yourself and these third parties. Unless otherwise indicated, any and all recourse to these contracts or agreements are strictly confined to the third party.
3.    You should not perform any ez-link Top-Ups during your bus ride.

5.     Auto Top-up

1.    Auto Top-up is an auto top-up service by SimplyGo that ensures that there is always sufficient value in your ez-link Card, EZ-Charms and ez-link Wearables for your public transport and retail transactions. You can only register for Auto Top-up with locally-issued MasterCard/Visa credit cards and you can link up to seven ez-link Cards to each MasterCard/Visa credit account.
2.    You warrant that the credit card belongs to you and that you shall be responsible for the validity of your credit card and update us when your credit card expires.
3.    Usage of the Auto Top-up service is subject to the Terms and Conditions of the use of Auto Top-up by Card, which can be found at https://www.simplygo.com.sg.

6.    EZ-Link Rewards

1.    By using the SimplyGo App, you will automatically be a member of the loyalty programme named “EZ-Link Rewards” operated by the Company and/or its Affiliates (“EZ-Link Rewards”).
2.    By using EZ-Link Rewards, you will gain access to the e-vouchers, promotions, discounts, free gifts, promotion codes and other benefits offered by the Company and/or third party merchants as shown on the rewards catalogue that is made available from time to time in the SimplyGo App.
3.    SimplyGo may, at its sole and absolute discretion, award you SimplyGo points (“Points”) which can be used to redeem for EZ-Link Rewards.
4.    SimplyGo may, at its sole and absolute discretion, issue you points for your spend on transit and retail purposes using your ez-link Cards. ez-link Card top-ups are not eligible for earning of points.
5.    SimplyGo may, at its sole and absolute discretion, increase or decrease the rate of Points to be awarded for each selected transaction as may be notified to you from time to time. You shall not be entitled to request from the Company any explanation pertaining to the calculation methods (for crediting the Points) or other matters relating to the Points or discounts for whatsoever purposes.
6.    You must use your Points earned to redeem for Rewards during their applicable validity period, which is 6 months from the month that the Points were credited in your account. There shall be no extension of time for the validity period of any unused Points. The Company shall have the right to deal with the expired Points in such manner as it deems fit in its absolute discretion. You agree that you will have no claim whatsoever against the Company for any expired Points.
7.    Points have no cash or monetary value and are not redeemable for cash in any form. They cannot be purchased, resold or transferred, for value or otherwise, under any circumstances.  Points shall not be regarded, construed, or used as valuable or exchangeable instruments under any circumstances, unless otherwise determined by SimplyGo.
8.    If you comply with all these terms and conditions and have the required number of Points, you may select and redeem applicable Rewards via the Application. Your redemption of a Reward is subject to the additional terms and conditions of the Company or the third party merchant (as the case may be) that offers the particular Reward that you wish to redeem.
9.    You must use your Rewards redeemed during their applicable validity period, which may vary across different merchants. There shall be no extension of time for the validity period of any Rewards redemption dates. You agree that you will have no claim whatsoever against the Company for any expired Rewards.
10.    You shall not hold SimplyGo responsible for any unintentional redemptions performed, nor will you contest the validity of redeemed Rewards. SimplyGo will not recognise any token used in representation of redeemed Rewards, other than the e-voucher generated in the SimplyGo App. This includes, but is not limited to photocopies, photo images, and letters of authorisation.
11.    Rewards are not redeemable for cash nor are they exchangeable for other Rewards under any circumstances. They cannot be resold, exchanged or transferred for value under any circumstances. Rewards shall not be regarded, construed, or used as valuable or exchangeable instruments under any circumstances.
12.    Points that you have successfully redeemed for a Reward cannot be exchangeable for another Reward under any circumstances. No requests for exchange of Rewards will be entertained.
13.    SimplyGo may at its sole and absolute discretion reject your request to redeem Points for any reason whatsoever, including without limitation, where there are insufficient Points to redeem for the particular Reward, or where the Reward is no longer made available or out-of-stock by the third party merchant, or where the Points you wish to use for redemption of Rewards have been issued to you in error etc.
14.    You may check your Points balance and redemptions made in the SimplyGo App.  Your Points balance and redemptions as set out in the Application shall serve as a conclusive evidence of the same.
15.    To the extent as permitted by applicable laws, SimplyGo reserves the right at any time to:

1.    vary, modify or amend the terms and conditions of EZ-Link Rewards (including adding or deleting any terms);
2.    terminate or modify the EZ-Link Rewards;
3.    revoke, adjust and/or recalculate any Points awarded;
4.    change the number of Points required for redemption of specific Rewards or substitute any Reward with another of a similar value;
5.    change the number of Points that can be earned on spendings on ez-link Cards;
6.    modify the qualifications and eligibility for earning Points;
7.    modify the activities that earn Points;
8.    modify the methods used to calculate the number of Points to be awarded;
9.    withhold or cease the awarding of Points to you; without prior notice to you and at its sole discretion.

16.    SimplyGo may suspend the calculation and accrual of Points to rectify any errors in calculation or adjust the calculation as it reasonably deems fit without giving you prior notice or reason.
17.    You shall be responsible for any taxes, levies or duties that arise in connection with the issuance of Points to you, your redemption of Points and/or the utilization of Rewards you have redeemed and all costs and expenses relating to the same shall be borne by you.
18.    SimplyGo is not liable in any way for any claim or dispute arising between yourself and any Merchant in relation to the goods and services redeemed from the Merchant using the SimplyGo App. SimplyGo is also not responsible for any benefits, discounts or programmes of any Merchant. SimplyGo is not responsible for delivery of the goods or services provided by a Merchant and SimplyGo makes no representation as to the quality, provision of performance of any such goods or services. You acknowledge that we are not acting as agent for any Merchant.
19.    You agree that any complaints, claims, disputes or refunds in relation to goods and services provided by a Merchant shall be resolved between that Merchant and yourself, and SimplyGo shall not be responsible for any refunds made or to be made by any Merchant in respect of a Merchant Payment (whether in full or in part).

2.    SimplyGo Value-Added Services

1.    By downloading the SimplyGo App, you can:

1.    Perform Motoring registration and activation (“Motoring”)
2.    Use the SimplyGo Digital Wallet (“Digital Wallet”) functionality to check the balance and view the transaction history of your Digital Wallet, as well as perform top-ups to, and make payments with the QR Code payment feature at selected merchants.

2.     Motoring

1.    Motoring is a post-paid card-less payment service provided by SimplyGo for motorists for their Electronic Road Pricing (ERP) and carpark (EPS) charges. You can register for Motoring with supported credit or debit cards. You can register up to three vehicles for Motoring by providing your car plate number to SimplyGo.
2.    Usage of the Motoring service is subject to the Terms and Conditions of the use of Motoring service, which can be found at https://www.simplygo.com.sg.

3.    Digital Wallet

1.    The Digital Wallet is a stored value facility which contains the top up stored value by you, where such stored value is capable of being used by you to perform purchases via QR Codes. You can also check the balance and view the transaction history of your Digital Wallet from the SimplyGo App.

Restriction on use of the SimplyGo App

1.    The following limitations shall apply:

1.    each Credit Card can only be added to one SimplyGo App;
2.    a maximum top-up amount is limited to S$100 for each transaction;
3.    you will only be able to make a maximum of five top-ups using the same credit or debit card each day;

2.    SimplyGo may, at any time and in its sole discretion, vary the limits for the above-stated limits.


Terms and Conditions – Family Account Feature

1.    The family account feature allows a collective group of SimplyGo App accounts to form a connected unit (“Family Account”).
2.    Users are required to have a registered account on the SimplyGo App before he/she can create or join a Family Account.
3.    A maximum of seven (7) SimplyGo App accounts can join a Family Account and each SimplyGo App account holder can join a maximum of two (2) Family Accounts.
4.    The Family Account feature will only be applicable for ez-link cards. When a user has joined a Family Account, the user will be able to nominate a maximum of three (3) ez-link Cards for usage within the Family Account feature.
5.    The user that creates the Family Account will be appointed the Family Account administrator (“Head of Family”). The Head of Family will be able to send invitation(s) to other SimplyGo App accounts to join the Family Account.
6.    The SimplyGo App account(s) that are invited to join a Family Account (“Dependent”) will have the option to accept or reject an invitation from a Head of Family. If the invitation is neither accepted nor rejected, it will expire after seven (7) days. By accepting the invitation(s), Dependents agree to grant permission to their Head of Family to view their ez-link card balance and transaction details and utilise other features available under the Family Account.
7.    The Head of Family may remove Dependents from their Family Account at any time. Dependents will also have the option to leave a Family Account at any time.
8.    Through the Family Account feature, the Head of Family will be able to have access to the following functions and other functions that are added from time to time:
•    view a Dependent’s ez-link card balance and transaction details;
•    receive notifications about low balance alerts for a Dependent’s ez-link card balance;
•    Top-up a Dependent’s ez-link card(s) remotely.

 

Use of the EZ-Link Digital Wallet

You acknowledge, agree and warrant that you are, and will at all times be, in compliance with the following:
1.    You are of legal age of majority to contract in the jurisdiction in what you reside (and in any event, no less than 18 years of age) and legally capable and permitted to accede to these Terms;
2.    Refunds in case of wallet closure shall be made to a local Bank account (local savings or current account). SimplyGo reserves the right to levy an admin fee on receiving your request to close the wallet;
3.    You have a valid local mobile number registered in the SimplyGo App and it is your responsibility to keep your mobile number up to date so that SimplyGo can communicate with you electronically should the need arise during your use of the Digital Wallet due to security or privacy concerns detected by SimplyGo or any relevant party;
4.    You understand and agree that if SimplyGo sends you an electronic Communication but you do not receive it because of reasons including but not limited to message being out of date, blocked by your service provider, or you are otherwise unable to receive electronic Communications, SimplyGo will be deemed to have provided the Communication to you.

 

Restriction on use of the EZ-Link Digital Wallet

1.    You must use your PIN number or biometric information to access and use the Digital Wallet. You are responsible for safekeeping and maintaining the confidentiality of your PIN number. You must not disclose to any person your PIN number and shall not authorize any person to use your PIN number for any purpose whatsoever. You agree to take reasonable measures and all due care to protect your PIN number against misuse by third parties;
2.    You should quickly reset your PIN number should you notice that your Digital Wallet has been accessed without your consent;
3.    You consent to receiving “push notifications” and email and/or SMS notifications from SimplyGo relating to your access to and use of the Digital Wallet.
4.    You acknowledge and agree that:

1.    the access to and use of the Digital Wallet is offered to you on an “as available, where available” basis;
2.    top up to your Digital Wallet can be done through MasterCard or Visa credit/debit cards. SimplyGo  shall deduct the money from your designated source of funds and load it to the Digital Wallet;
3.    you are solely responsible and liable for any access to use of the SimplyGo App effected through the use of your Password, notwithstanding that your Password may have been used by any other person without your knowledge or authority;
4.    SimplyGo is not held responsible and liable for any wrongly configured purchases, whether of purchase value or recipient;
5.    you will ensure your mobile number is kept up to date on the SimplyGo App;
6.    you will access the Digital Wallet Management Portal with your SimplyGo App log-in details should you decide to terminate this application and trigger refund of the remaining balance from the Digital Wallet to a designated local Bank Account which you will input via the Digital Wallet Management Portal

5.    Various limits have been implemented to safeguard the potential losses and you are aware that;

1.    Maximum amount the Digital Wallet can contain at any one time is $500;
2.    Any configured top-up amount that will cause the Digital Wallet balance to exceed the maximum stored amount in the Digital Wallet will automatically block the top-up and trigger an error message;

6.    SimplyGo reserves the right to investigate complaints or reported violations of these Terms and to take any action SimplyGo deems appropriate, including but not limited to reporting any suspected unlawful activity to law enforcement officials or regulators and disclosing any information necessary or appropriate to such persons without any further notification to you;
7.    SimplyGo may, in its sole discretion, change, add or remove any feature or functionality of the Digital Wallet at any time without any prior notice. Your continued use of the SimplyGo App shall be deemed to be your conclusive acceptance of such changes;
8.    SimplyGo reserves the right to impose, change and/or amend at any time the fees payable for your access to and use of the Digital Wallet. Such changes shall be deemed effective upon posting on the website and your continued access to and use of the SimplyGo App shall be deemed to be your conclusive acceptance of such changes;
9.    For the avoidance of any doubt, you acknowledge and agree that the use by you of any mobile services in connection with your access to and use of the Digital Wallet may entail additional charges with the respective mobile service providers and you shall be solely responsible and liable for such charges where applicable


EZ-LINK IN-APP GAMES TERMS & CONDITIONS

1.    These Terms and Conditions (“T&Cs”) shall apply to all in-app games contests organised by SimplyGo Pte. Ltd. (“SimplyGo”).
2.    By engaging in any game, users agree to be bound by these T&Cs and the decision(s) of SimplyGo in relation to and in connection with any and all in-app games contests.
3.    The T&Cs governing all in-app games contests incorporate the General Conditions of Issue and Use for EZ-Link cards and T&Cs for the SimplyGo Mobile Application and the EZ-Link Wallet, located at https://www.simplygo.com.sg/ . If there is any conflict or inconsistency between these T&Cs and other T&Cs, these T&Cs will prevail only in respect of all in-app games contests.
4.    Users consent under the Personal Data Protection Act 2012 to the collection, use and disclosure of their personal data by/to SimplyGo and such other third party for the purpose of administration of prizes for in-app games contests and users confirm that they have read and agree to the terms of the SimplyGo Privacy Policy.
5.    Users may start a game listed on the ‘Discover’ tab in the SimplyGo mobile application (“SimplyGo App”).
6.    To view a particular game, users can click on the selected game tile displayed on the ‘Discover’ tab. Once they are on the selected game details page, they can click on the ‘Proceed’ button which will take them to the main game page.
7.    Each game is only valid from the start and end date of the stated game period which will be detailed in each game’s unique T&Cs. For T&Cs pertaining to the game, you may tap on “Read T&Cs here” upon launching the game.
8.    Where prizes or incentives involve crediting into the winner’s EZ-Link Wallet, the respective users must hold a valid EZ-Link Wallet and must agree to be contacted by SimplyGo to receive their prizes.
9.    Upon receiving any EZ-Link Wallet cashback, the risk of loss and title for the EZ-Link Wallet cashback passes to the qualified user. Qualified users are solely responsible for keeping their EZ-Link Wallet cashback safe and preventing it from any unauthorised use. SimplyGo shall not be liable to the users once their EZ-Link Wallet cashback is used, regardless of whether it is used by the qualified user or any other third party. SimplyGo shall not be responsible in the event that any EZ-Link Wallet cashback is lost, or used without the users’ permission.
10.    The prizes or incentives cannot be used to offset any outstanding amounts owed to SimplyGo prior to a user’s participation in any in-app games contests. Refunds and/or exchanges of the prizes will not be entertained.
11.    SimplyGo shall not be liable for any failure of any EZ-Link Wallet cashback to work in the manner described in these T&Cs caused by a third party such as the failure of the internet, of a computer, mobile or other devices used to access the internet, or of an internet service or mobile network provider. For the avoidance of doubt, the User acknowledges and agrees that his/her use of the EZ-Link Wallet cashback may entail additional charges with his/her mobile services provider and he/she shall be solely responsible and liable for any such charges.
12.    SimplyGo will not be responsible for any injuries, loss, claim or damage suffered or incurred in connection with all in-app games contests (including but not limited to any error in computing any qualifying transaction, any breakdown or malfunction in any computer system or equipment) and/or any notices, letters or correspondence lost, stolen or misdirected in the postal system or telecommunication system, and the consequences arising from the non-receipt of such communication.
13.    When a qualified user receives or redeems his/her EZ-Link Wallet cashback, he/she agrees that the laws of Singapore apply, without regard to principles of conflict of laws, and such laws will govern these T&Cs. SimplyGo reserves the right to change these T&Cs from time to time at its discretion to the extent permitted by law.
14.    SimplyGo reserves the right to investigate complaints or reported violations of these T&Cs and to take any action SimplyGo deems appropriate, including, but not limited to reporting any suspected unlawful activity to law enforcement officials or regulators and disclosing any information necessary or appropriate to such persons.
15.    SimplyGo’s decision on all matters relating to all in-app games contests shall be final. No correspondence or claims will be entertained.
16.    SimplyGo may vary these T&Cs or suspend or terminate any and all in-app games contests without any prior notice or liability to any party.
17.    SimplyGo reserves the right to vary these T&Cs at any time without prior notice.
